Man that is an excellent point. I can't count the number of times I was kicked in the groin as a little kid. Why aren't these little girls on the sex offender registry??

Burns referred to what happened as "something stupid kids do."

That begs an excellent question: if these boys had forcibly penetrated a girl against her will with a broom handle, I have very little doubt the police wouldn't immediately call it rape.

I'm no expert on rape law, but the TN rape def provided in the op is

n the post, Fletcher cites Tennessee Law, which he says is very clear on what constitutes rape. He writes that rape is the sexual penetration of a victim by the defendant or of the defendant in any of the following circumstances:

Force or coercion is used to accomplish the act The sexual penetration is accomplished without the consent of the victim "Sexual penetration" means sexual intercourse or any other intrusion, however slight, of any part of a person's body or of any object into the genital or anal openings of the victim.

No, it isn't gender neutral. Because if you think of rape as 'sex without consent' then this removes a whole class of rape: rape of men by women.

Ok now it doesn't say what I thought it said. When I first read it I guess i did the the automatic double deletion thing, because i really thought it said 'penetration of or by the victim' where is says 'sexual penetration of a victim by the defendant or of the defendant ' I guess I just miss resolved all those clauses, reading it as i had i believed that under this law a man who was forced at gun point to have intercourse with a woman would have been 'raped'.

It would be nice for it to be spelled out, but I think that, just as the author of the piece I linked to, if we could get it listed in examples and training manuals it would be just as effective without having to fight for the law to be changed. As long as the police, prosecutor, and court uphold it, that its not explicit would be unimportant.

A state court in Tennessee is not going to look at the FBI's definition of rape when it prosecutes (or doesn't prosecute) a state crime, based on a state statute.
