ID doesn't matter. She can have 10 forms of state issued ID from identity theft that says she's legal and you still go to jail if it's a strict liability state. THAT is how outrageous strict liability statues are.

[–]Spectrumpigg 10 points11 points12 points 10 years ago (7 children) | Copy Link

Don't you have to be 18 or older to use ok cupid?

[–]Ccracked 10 points11 points12 points 10 years ago (4 children) | Copy Link

The site isn't running i.d. and credit checks.

[–]blackcat21 2 points3 points4 points 10 years ago (3 children) | Copy Link

Yeah, but the terms of service when you make an account states you have to be 18.

[–]Ccracked 3 points4 points5 points 10 years ago (2 children) | Copy Link

Of course it does. But I doubt that argument would fly in court. And I seriously doubt OKC would sue her for breaching the ToS. They could at least block her.

[–]aakksshhaayy 4 points5 points6 points 10 years ago (1 child) | Copy Link

Well why can't the convicted men sue OKCupid. (Who will then sue the girl)

[–]Ccracked 6 points7 points8 points 10 years ago (0 children) | Copy Link

Not a bad idea. Sue OKC for not using due diligence in enforcing age limits. He can definitely demonstrate legitimate pain and suffering.

For some reason it also isn't a defense to have met her drinking in a bar despite the people literally trained to spot a fake ID having not caught it either.

[–]Subliminal87[S] 3 points4 points5 points 10 years ago (0 children) | Copy Link

Yes.

[–]bat_mayn 34 points35 points36 points 10 years ago (73 children) | Copy Link

I don't understand - did these men meet the girl physically and then sexually abused her? I mean, wouldn't they know she was 12-13 upon meeting her?

[–]Subliminal87[S] 72 points73 points74 points 10 years ago* (54 children) | Copy Link

It depends. Some girls in our family who are young look 18 or older.

I think blame lies with everyone. The girl is still on okcupid. A lot of comments on Facebook say don't blame the girl.

A good friend of mine had an issue earlier this year with a 16 year old. Claiming to be 18. Ended up giving a statement to the detectives because I know she sent texts saying she was 18 because he was nervous he was 20.

They ended up getting official copies of the texts. Confirmed that she continued to lie. The mother wanted to press charges and so on. Finally two months ago they decided not to go ahead with charges as it came to light she was doing it to other girls and the girl admitted to the detective it was consensual, but the Kim insisted otherwise.

However it's not the same girl in the article. But shit like that pisses me off.

Edit: words.

Same thing happened to me except my outcome isn't so fortunate. Met a girl on an app called Whisper (age gate says 17+) who claimed to be a freshman at a local college. I saw her during the summer dating for about 3 months, and eventually find out she's actually 15 by having her dad come home one day when I'm over. Police get called, and she lies to them saying there wasn't a relationship. No charges filed.

I get a call the next day from her cousin telling me that she tried to overdose on Zoloft and was headed to the hospital. One of her friends that I never met reached out to me to contact her at the hospital. She told me she attempted to kill herself because she thought I was arrested, and it was all her fault. I assure her I'm fine, and that I'm not in jail. She gets sent off to some institution for psychological evaluation. She called me a few times from there, and I reluctantly took the calls because I was I feared triggering someone so emotionally fragile. I was supportive about her recovery, but I let her know in no uncertain terms that our relationship is over. That I had no interest in being with someone so young who lied to me about who they really were.

Two months later I get a phone call from her. My stepfather had just passed away so we talked about that. Then she changes the conversation to wanting to talk about sex and seeing me again. I tell her again we can't and I'm not interested in it. I never hear from her again after that.

Two more months pass, and I get my house raided by the FBI. I get arrested and charged with online enticement which carries a 10 year mandatory minimum. Apparently, the last phone call she made was recorded by county investigators, and passed along to the FBI. They edited out portions of the conversation where I said I wasn't interested in seeing her, and re-recorded it so it wouldn't show up on audio forensic testing. (Stop and start signatures missing and one half of the left and right mp3 was missing. Showing that it was passed through an aux cord)

I can't afford $100K for a federal attorney so I get appointed a public defender who pushes me hard to take a deal. They told me all sorts of fantasies like you'll just get probation or house arrest. That a jury would never believe it. So like a fool I take a deal for a Mann Act violation. I live in PA and she lives in NJ. Same stuff they charge human traffickers with. I stupidly end up taking the deal because the possibility of going to jail for 10 years seemed insane.

Fast forward to last week. I end up sentenced to 7.5 years. I'm completely beside myself right now. I feel deceived from every angle. The people that were supposed to be protecting my best interests even deceived me. My life is ruined now because of this. So when I see stories like this I feel like these guys got off light because this could've easily turned out much worse. There's no legislation in place for girls that go online deceive men for their own interests. I had zero interest in someone that young, and now I'm going to jail like some sort of child molester. I report the beginning of September.

TLDR: Same thing happened to me as the guys above. Except I got charged federally and am going to jail for 7.5 years.

[–]Subliminal87[S] 32 points33 points34 points 10 years ago (5 children) | Copy Link

Wow, I don't even know what to say. That's an insane amount of fucked up. I am from Pennsylvania as well. Shit like that shouldn't happen, and if it does I think if the other person is lying about their age..then they should be held responsible.

I hope things get better man! What part of pa?

[–]ppassthrowaway 14 points15 points16 points 10 years ago (4 children) | Copy Link

I'm from Philadelphia.

[–]Subliminal87[S] 12 points13 points14 points 10 years ago (2 children) | Copy Link

That really sucks.

Seems like in order to have a good defense you got to be rich. Good luck.

[–]ppassthrowaway 14 points15 points16 points 10 years ago (1 child) | Copy Link

Definitely. It makes me sick to my stomach to even think about this stuff. I feel like a half way competent attorney would've chewed right through this case, but instead I get stuck with an overworked public defender that's only interested in moving paper off their desk. The game is rigged and there's a reason why a high percentage of federal cases end up as plea bargains. People can't afford competent attorneys and the ones that are assigned to them aren't motivated to win.

This happens much more than you know. I'm a therapist who works for a prominent psychologist (think tv, radio, many awards) and many times we get males in for this exact reason or very similar.

BUT believe it or not we get 3x as many females in for the same reason but who were not charged and instead received mandatory counseling.

Source; 11 year therapist working on my Ph.D. in clinical psychology, who has seen countless examples of this.

[–][deleted] 15 points16 points17 points 10 years ago (1 child) | Copy Link

Wait.

So I can't even get my genuinely abusive, 10+ years on me, nobody-lied-about-their-age ex-girlfriend thrown in prison, but this dude is getting nearly a decade because of multiple counts of misrepresentation?

[–]elfmeh 24 points25 points26 points 10 years ago* (0 children) | Copy Link

Maybe it's worthwhile to cross-post this to r/legaladvice. I'm really not sure what they may be able to tell you, but I'd think it's at least worth asking people more proficient in the law. That really sucks. I feel for you dude.

Edit: I cross-posted it for you, if that's alright.

7.5 years? Jesus just take everything you can and flee to Cambodia or something...

[–]wordjedi29 points 10 years ago* [recovered] (2 children) | Copy Link

Man, that's so fucked up. I don't know what to say. You hooked up some chick who lied about her age, then talked to her on the phone. 7.5 years for that shit!

It's too bad stupid fucking feminists over on TwoX and Jezebel turn a blind eye to this stuff and continue yammering on about the "micro-aggressions" that "triggered" them and hurt their poor baby feelz. Seriously, some people are mildly inconvenienced by some dude spreading his legs too far on the subway, and another is going to jail for 7.5 years. Which case should we flood the internet with and dominate daytime TV with? Micro-aggressions of course! That's what really matters.

How the fuck is this period in history not a gender hatred version of Stalin's Russia?

[–][deleted] 6 points7 points8 points 10 years ago (1 child) | Copy Link

The only thing I feel that stops me from genuinely wanting to kill myself sometimes is knowing that there exists some people who at least KNOW right from wrong, even if they have no power to truly enforce it.

In any case, Aliens need to hurry up and come rescue me, I'd take a few anal probes over this shit any day.

Were you not sent to jail immediately? Dude, what are you doing, flee the country today, 7.5 prime years of your life isn't worth being in America, much less for what you described above. I'd be packing for central america immediately and going from there.

[–]uber1337h4xx0r 8 points9 points10 points 10 years ago (6 children) | Copy Link

Smart idea. Leave with virtually no money, get caught at a border crossing, get extra years tacked on.

[–]41145and6 7 points8 points9 points 10 years ago (0 children) | Copy Link

Do you know what's going to happen to him in federal prison on child molestation charges?

It's worth the risk.

[–]Chamilionaire8 points 10 years ago* [recovered] (4 children) | Copy Link

Who said anything about going through an official border crossing station? And it's not like Mexico is enforcing Americans from going south into its country. And he says he didn't have lawyer money but that doesn't mean he's flat broke. Sure it would take some time to improve your future quality of life, but that's still infinitely better than the lifestyle of a jail cell

[–]uber1337h4xx0r 2 points3 points4 points 10 years ago (3 children) | Copy Link

What I meant by the money is that he can't withdraw it from a bank. Most people don't have enough cash to last more than a week. Also, driving from Pennsylvania to Mexico without getting caught is highly unlikely.

[–]Chamilionaire2 points 10 years ago* [recovered] (2 children) | Copy Link

the money is that he can't withdraw it from a bank

Why not? He's not barred from his finances. If he withdraws it all at once, you are right, if there is a red flag to be set off, that would do it, but...

driving from Pennsylvania to Mexico without getting caught is highly unlikely

Don't speed or break laws like your life depends on it. Pay for gas and food with the cash. Drive there in as straight of a shot as you can. Dump the car when you are within walking distance of Mexico (or at a boat harbor or whatever).

Did you not read his situation? 7.5 years in your 20s for that? And a ruined life here if anyone ever googles your name? Plus getting the shit kicked out of you in prison for being a child molestor? America is nice, but not that nice. Life will suck at the new location for a bit, but certainly not for 7.5 years.

[–]uber1337h4xx0r 0 points1 point2 points 10 years ago (1 child) | Copy Link

Once you get to Mexico, what will you do with the few dollars that you have, though? Especially if you don't speak Spanish?

[–]Lemminger 8 points9 points10 points 10 years ago (0 children) | Copy Link

Get the local news on the case!!

[–]Ozymandias195 2 points3 points4 points 10 years ago (0 children) | Copy Link

I don't even know what to say man, that's so fucked up. I don't know anything I can do for you but if you want to vent to someone anonymously I'll be willing to listen. If I were you I don't know how I'd contain my anger at the system and the people who screwed me over

[–]NotThatEasily 2 points3 points4 points 10 years ago (1 child) | Copy Link

In all honesty, I'd run. Find a country without extradition and just fucking run.

[–]sockmess 2 points3 points4 points 10 years ago (0 children) | Copy Link

He more than likely had to give up his passport. So he can only go to Canada or South on foot. And even if he does just about every country on the continents will send him back. Maybe Venezuela might not but then again its Venezuela.

[–]41145and6 3 points4 points5 points 10 years ago (0 children) | Copy Link

I'm not by any means making a suggestion, let's be clear about that. You should not do this and I am not suggesting you should by any means at all.

However, I would very likely hunt and kill as many of these fuckers as I could before they gunned me down because getting sent to federal prison on child molestation charges is effectively getting sentenced to regular rape and beating by the nastiest motherfuckers on the planet and I for damn sure would not be willing to go out like that.

Again, this is not a suggestion or a call to action at all. I'm not telling you that it's a good idea, just the emotional response of a man trying to imagine the rage I would be feeling at the situation.

[–]rrawk 1 point2 points3 points 10 years ago (0 children) | Copy Link

flee. just flee.

[–][deleted] 1 point2 points3 points 10 years ago (2 children) | Copy Link

I really want to believe this is a fake story. How can they fucking edit the convo to make you look guilty.

That's insane.

[–]ppassthrowaway 1 point2 points3 points 10 years ago (1 child) | Copy Link

Unfortunately, it's not a fake story at all. The recording itself shouldn't have been admissable in the first place. It was state investigators in NJ (one party consent wiretap state) recording a conversation with someone in PA (two party consent state). They broke PA law by recording it in the first place.

Second, by removing the section where I told her I wasn't interested in seeing her because she was too young they removed any evidence of my mens rea or state of mind. All they needed was some sort of evidence that something sexual took place to get charges filed. Tampering with the recording is extremely clear. There are periods of silence with click sounds that are audible. Think of the Nixon tapes were sections of it were removed and all that remained are the clicking noises otherwise known as transients.

[–][deleted] 0 points1 point2 points 10 years ago (0 children) | Copy Link

Yeah that's fucked man, sorry.

[–]Terminal-Psychosis 3 points4 points5 points 10 years ago (0 children) | Copy Link

This country is absolutely batshit insane. It serves absolutely zero purpose putting someone like you in jail.

Well, except the jails and politicians make money. God damn this whole system needs to fucking burn.

[–][deleted] 0 points1 point2 points 10 years ago (0 children) | Copy Link

[–]KKV 0 points1 point2 points 10 years ago (0 children) | Copy Link

Shit, man. If I could kill 'em and get away with it, I would. Be as productive as you can in prison.

[–]TheKingofMusk-4 points 10 years ago* [recovered] (11 children) | Copy Link

I saw her during the summer dating for about 3 months, and eventually find out she's actually 15 by having her dad come home one day when I'm over.

I'm willing to accept for sake of argument that you somehow didn't know she was underage for several months. Upon finding out, most would have severed all ties indefinitely.

She told me she attempted to kill herself because she thought I was arrested

You could have assured whoever called that you were fine and you she gets better, but for legal reasons you should cease all contact indefinitely.

I reluctantly took the calls

She was safe in a psychiatric facility. She probably shared everything that went on between you two, in addition to other things you've probably left out. This was all forwarded to the police.

Then she changes the conversation to wanting to talk about sex

The police had investigated you and needed evidence that you committed the crimes they believed you did, then used her for more evidence by baiting you into a verbal admission of what transpired.

so I get appointed a public defender who pushes me hard to take a deal.

The FBI raided your house. In addition to the recorded conversation, they likely found lots of other things on your electronics. Depending on the amount of evidence, a plea deal is really the only option. Even then, the conversation was likely enough evidence.

They edited out portions of the conversation

It sounds like they simply edited out the benign parts for brevity, but could have supplied uncut transcript/audio at your attorney's request. Your jury wouldn't have believed your theory.

Even if you never did or discussed anything illegal with her, it's still highly suspect that you'd want to remain strictly platonic friends with a minor whom you have no familial relationship. I don't know precisely what you did wrong, but there's definitely much more to your story.

You're going to have to make this sound way more believable for when others force you to share why you went to prison. People are more intelligent than you're giving them credit for.

[–]Terminal-Psychosis 6 points7 points8 points 10 years ago (10 children) | Copy Link

None of this even should be nessicary. He acted in a very acceptable, moral, adult manner.

The only fucked up thing in this entire situation is the inasnity of our police and "justice" system getting away with framing him for such a completely innocent non-crime.

[–]TheKingofMusk-3 points 10 years ago* [recovered] (9 children) | Copy Link

Just in case you're serious:

If you believe everything he typed is the absolute truth and there is nothing more to his story, then yes, he did absolutely nothing wrong and he was totally framed by both the county police and FBI.

As per my above post, I believe there's much more to his story than he indicates, and that he is actually guilty of a crime.

[–]Terminal-Psychosis 7 points8 points9 points 10 years ago (8 children) | Copy Link

What are you basing that on?

Fully realistic story, just as it stands. the court systems and society in general is very sexist against men these days.

[–]TheKingofMusk-6 points 10 years ago* [recovered] (7 children) | Copy Link

The level of harshness this sub generally describes is the difference in punishments meted out to men vs women, as well as crimes women are generally not even accused of committing when there's actual evidence they did.

This guy's post describes an incident where multiple law enforcement agencies conspired to fabricate evidence to imprison him. This is undertaking a massive collective risks on all their parts, with the assumption that there would be no dissenters who would out them.

I suppose there's no way to argue this conclusively since the only evidence we have is what this guy says. So I guess we can just agree to have different opinions regarding what really happened. It is speculation, after all.

[–]Terminal-Psychosis 1 point2 points3 points 10 years ago (6 children) | Copy Link

Risks? Massive risks? from who? Who is going to "Out" them? who the hell would even try, or care?

What the heck are you talking about man? They have zero to loose.

it is stupid speculation. Most likely it happened exactly like dude described it. Fully realistic.

The strange fantasy you're describing does not even begin to make sense.

[–]TheKingofMusk0 points 10 years ago* [recovered] (5 children) | Copy Link

Then this is your agreement in that we both have valid but different ideas, neither of which can be proven or disproven without more information.

[–]RedMistKnight 0 points1 point2 points 10 years ago* (0 children) | Copy Link

My sister is 15 her friends are all 15 at least 3 of them would pass for 19-20

[–][deleted] 11 points12 points13 points 10 years ago (4 children) | Copy Link

I worked 6 months at an elementary school and we had middle schoolers (14-15) come work there for a week at a time because of some work practice program thing, and before I knew about what it was I thought the first girl to come in and work there was at least 20, but she was 13 or 14. Every girl that came in after her looked at least 18 to me. I still don't get what the fuck happened, when did that young girls start looking my age? It's really, really easy to mistake a well-developed 12-13 year old for an 18 year old.

higher estrogen from childhood obesity

Weird, I only seem to think girls are older than they are when they're not overweight/obese, I can tell if they're underage pretty easily. Doesn't mean anything really, maybe I've just been "lucky".

[–]toscott_2000-2 points 10 years ago* [recovered] (1 child) | Copy Link

Honestly, I have done some research on this. There seems to be some additives in the water we drink that makes girls develop earlier in life. For the life of me I cannot remember what it is that is in the water. But it makes sense. I am 47, girls these days look MUCH older than while I was growing up.

[–]Juffo-WupDeepChild 2 points3 points4 points 10 years ago (0 children) | Copy Link

There are many, many compounds that contribute to this phenomenon, not just one. Glyphosate, BHA, BHT, BPA, TBHQ, rBGA, plus all the other synthetic growth hormones they feed cattle and poultry. Not to mention the birth control hormones that get introduced to the water supply every time a woman using them urinates. I've seen girls as young as 8 with fairly sizable breasts.

[–][deleted] 4 points5 points6 points 10 years ago (0 children) | Copy Link

Seeing as I have never been with a 12-13 year old and I am betting you haven't either, what would be our frame of reference? What specifically distinguishes a 12-13 year old from an 18 year old that any man can pick up on?

Without any more info, I have no problem giving these guys the benefit of doubt.

As a grad student in my late 20's, every time I go on campus I'm astounded by how young the freshman look. These kids are supposedly 18 and I seriously can't see much difference between them and my 12-14 year old cousins.

Makes me feel old as hell.

wouldn't they know she was 12-13 upon meeting her?

How do you recognize well developed 12-13 and 18? especially with makeup.

[+]MaunaLoona -42 points-41 points-40 points 10 years ago (5 children) | Copy Link

There is no such thing as a well developed 12-13 year old that looks 18.

I had a buddy in junior high with a full beard. He could buy cigarettes from the gas station at 13. Your point?

[–]Terminal-Psychosis 7 points8 points9 points 10 years ago* (2 children) | Copy Link

Buuuulllshit. They sure as hell are.

Chicks these days are maturing much faster than ever. Dressing like downright sluts too. Shit is scary.

Hormones in the food, man. While young girls are developing faster, young boys are simultaneously becoming more effeminate or androgynous.

13 year old girls should not have double D tits, dammit!

[–]Nulono 0 points1 point2 points 10 years ago (0 children) | Copy Link

It's more likely just adequate nutrition. Same reason we're getting taller.

[–]arkangelic 0 points1 point2 points 10 years ago (0 children) | Copy Link

you need to get out more. there are plenty out there like that. shit my niece is 11 and looks 17

[–]novaquasarsuper -5 points-4 points-3 points 10 years ago (1 child) | Copy Link

Identification. Conversation. 12 yr olds tend to only know 12 yr old shit.

[–][deleted] 6 points7 points8 points 10 years ago (0 children) | Copy Link

Stupid bitches know only 12 yr old shit too.

[–][deleted] 2 points3 points4 points 10 years ago (0 children) | Copy Link

Personally I think anyone younger than 20 looks like a kid . Ive seen plenty of 6ft 13 year old girls. Kids are bigger these days.

[–]RedMistKnight 0 points1 point2 points 10 years ago (0 children) | Copy Link

My sister is 15 her friends are all 15 at least 3 of them would pass for 19-20

I know quite a few people from Lancaster and this doesn't surprise me in the least. Like half of that town is collectively fighting suppressed deviant sexual urges.

[–]Subliminal87[S] 2 points3 points4 points 10 years ago* (0 children) | Copy Link

I stay out of Lancaster City. The part of the county I'm in is ok.

When kids lie they are supossed to be held accountable by authority figures like parents, teachers, etc.. so why is it that in these cases, the authority figure (the law and it's parts) ignores their lies?

I see a problem with that too but yeah, someone wrongly killing a lion gets far more media attention than lying public servants.

[–]Terminal-Psychosis 11 points12 points13 points 10 years ago (0 children) | Copy Link

The real victims here were those men.

This little predator is still free to mess with other people's lives. She's the one that deserves to be punished.

Lying little slut is dangerous.

I swear this is getting more and more to be like nottheonion material.

[–]bonecrusher1 4 points5 points6 points 10 years ago (1 child) | Copy Link

fuckin hell i thought this was going to be about a 16 year old trying to act mature, holy fuck that kid is 12 - they must have known something is up and still went through with it shiiiit

[–]bsutansalt 2 points3 points4 points 10 years ago (0 children) | Copy Link

You'd be surprised. Not all 12-13 year olds will look like that, but now and then absolutely that can happen nowadays. It's almost as if there's something in the water...

Strict liability is basically the sex crime equivalent to zero tolerance policies.

Just about the only thing an accused can realistically do is plead not guilty and have a friend paper the court with leaflets educating people about jury nullification when the jurors are leaving court for the day.

Yesterday a friend recommendation popped up for a girl that listed date of birth 1989. When you look at the picture it's painfully obvious she was born in 1999. That's for a site that isn't primarily designed for romance. Dudes gotta start being more vigilant when online to spot this stuff. If a girl is overly interested she is more than likely under age, else there will be obvious signs of adulthood and less desperation from their end.

[–][deleted] 1 point2 points3 points 10 years ago (0 children) | Copy Link

Overly interested = under 18?

[+]novaquasarsuper -8 points-7 points-6 points 10 years ago (0 children) | Copy Link

I guess you're being downvoted because people want to hold on to their excuses for fucking kids. It's the kid's fault to them. Not the responsible adult.

Shit like this makes me stay a virgin. I don't feel this planet is worth it if bitches do Shit like this

[–]UncharminglyWitty 20 points21 points22 points 10 years ago (0 children) | Copy Link

Sure. This is why. Nothing else.

[–]novaquasarsuper -3 points-2 points-1 points 10 years ago (0 children) | Copy Link

Has nothing to do with the fact that you call them bitches?

Grown men have sex with 12 yr old. Grown men go to jail. I say the system worked.

[+]MaunaLoona -10 points-9 points-8 points 10 years ago (5 children) | Copy Link

If she was 15 or 16 I could understand. But 12? It's impossible these people really thought he was 18.

[–]Kl3rik 14 points15 points16 points 10 years ago (0 children) | Copy Link

There are 20 year old porn stars that look like they are 13, it's not a stretch. There are also plenty of 13 year olds that look like they are 20.

[–]sockmess 3 points4 points5 points 10 years ago (3 children) | Copy Link

A tall 12 year old that already passed or in the process of puberty with developed breasts and hips can pass. Maybe her conversation wont pass for a 25-30 year old woman but could easily pass for 18. She didn't say 21 so you don't have to card her for bar dates.

[–]novaquasarsuper -3 points-2 points-1 points 10 years ago (2 children) | Copy Link

Other than Doogie Howser, I don't know of any 12 yr old that would pass for 18 in a conversation. Stop making excuses for fucking little kids.

[–]sockmess 2 points3 points4 points 10 years ago (1 child) | Copy Link

How many 18 year olds is giving real deep conversations. There conversations is usually the same level of a preteen with just more crusing.

[–]novaquasarsuper -3 points-2 points-1 points 10 years ago (0 children) | Copy Link

Compared to a 12 yr old? Every single 18 yr old on the planet that doesn't have Autism.
