Unless the woman made an agreement (i.e. marriage). In which case it can be tossed, and any new agreement she wants enforced on the guy.

This is an unusual case where the guy manages to get the agreement tossed.

It was thrown out because it was one sided according to the judge. That violates one of the tenets of a valid contract.

Common law of contracts requires that there be some consideration for both parties, i.e. they have to get something out of it. Agreeing "to try to resolve the couple’s marital problems" is not something the performance of which is measurable and would not be regarded as consideration.

I'm kind of surprised by the judge's reasoning. Throwing out the contract for being one sided (lacking consideration) or being illusory (promise to "work on marriage" not an enforceable promise) opens her up to being overturned on appeal.

There was an easier resolution: by accepting the $10,000, the children had given up their rights under the contract. If a third party beneficiary surrenders their rights under a contract the contracting parties can no longer enforce the agreement on behalf of the TPBs.

He should not have signed that agreement if he did not intend to honor it. No court would have assigned this kind of obligation to him. He done fucked up. I hope that his kids didn't enter into any kind of important commitment predicated on the legal assurance of receiving a stipend until they were 30.

It says right in the article that he'd pay the stipend and she would agree to work on the marriage. They're now divorced. Obviously, she failed to uphold her side of the agreement.

In what universe? Saying that you will work on something is no kind of promise that you will fix it. This was a stupid contract all around, but just based on the information provided, it does not seem to be unconscionable.

You're lecturing him about it but you're forgetting that she's broken up with him and didn't even bother to try and get back together. He's only responding to what she did and so is the judge, she's the one who broke the agreement not him.

Women are not infantile and blameless beings, read the damn article, adding to that, this isn't paying for the kids' food or wellbeing, they're fucking Ivy Leaguers.

He's responding to (what you assume) she did by punishing their kids? Why would you find that acceptable? "Stay in this marriage, or I'll cut off the kids? I've promised not to, but I will anyway if you don't do what I want?" Decent people don't use their kids as leverage to keep their spouses.

I would have supported a parent of either sex who did not wish to offer a stipend to their adult children. But he did offer it, and he should be held to it.

So gainfully employed adults should be perfectly OK with losing sources of income that were promised them via legal agreement?

Imagine you has a grandmother who has formally committed to paying you a living stipend through age 30 - not just a verbal agreement, a signed contract - not entirely unusual in wealthy families. Then she tries to back out if it, not because of anything you did, but because she's pissed off at your mom. Would your reaction be "oh well, it's mom's fault for not keeping Grandma happy" or "WTF Grandma, I've made plans for my life based on the commitment you made to me, why are you using me as a pawn in your war with my mother?"

  2. The contract wasn't between the dad and the kids. They did nothing to get it so they shouldn't feel entitled to handouts
