OK just the regular reminder that "pedophilia" means attraction to prepubescent kids like eleven year olds maybe. Not sixteen, which would be legal (if she wasn't the teacher that is) in several states (in NY it's 17).

If she had resigned as teacher and did all this in a different state it would be legal.

Of course I agree that the story would be handled very differently if the teacher was male.

That's part of the problem. If you go to Spain or Germany, its 14 there. Are S and G complicit in pedophilia? Nope, because its a younger age pedophiles are attracted to. Furthermore, a pedophile is not synonymous for a child molester. A pedophile can never touch a child sexually their entire life.

Meanwhile, here in Germany it's actually legal for teachers and students aged 16 or older to have a relationship (the age of consent for people in no situation with such a power imbalance is 14). (Doesn't mean it would be socially acceptable or condoned by the school necessarily, I imagine a teacher might me relocated to another school if they found out.)

Morals are not universal, they are often arbitrarily different between societies.

Anyway, the term ephebophilia is more scientifically accurate.

This was absolutely sexual abuse by an authority figure, there is no arguing that.

My point in posting that video is that not every child, even if they are a willing participant, is going to be happy with the abuse when they grow up.

If he gets an STD and ends up spreading it to others? If he ends up paying child support?

The reason we have statutory rape laws isn't because such relationships are necessarily abusive, it's because many at that age are not mature enough to weigh possible negative consequences versus immediate gratification and ensure they minimize those risks. Many also lack the confidence to resist peer pressure.

The stereotype that he'd be high-fiving his friends is a perfect example; someone high-fiving over scoring with a teacher obviously considers peer approval of sexual proclivity an important factor in having sex, which indicates hes not mature enough to provide meaningful and informed consent, leaving adults around him with some level of responsibility not to exploit that immaturity until they reach such an age that we consider most mature 'enough' to make their own choices.

What is a reasonable age is of course debatable. 16, 17, 18, people are different anyway. Maybe having a sexual counsellor available to ensure the involved people know what they're doing and aren't coerced would be another option. But I think it's hard to come up with a general one-size-fits-all rule, so it's going to be somewhat arbitrary however you do.

That actually varies a lot between jurisdictions and ultimately comes down to practical issues. In those where similar-age is allowed it's usually because it simply doesn't serve any purpose to hold either or both parties as accountable as an adult; the point is accountability for those who should know better, not random criminalization of teenagers doing stupid things together.

"should know better".. than to have sex? If teens don't know better, then their parents would be at fault. But then there's the age of criminal responsibility, which means that a parent's children can be held responsible for their own actions. Hence why we have juvenile prisons.

What should they "know better"? As for random criminalization, teens can be locked up for doing stupid things together, such as lighting something on fire, or burglary, or murder.
