What's the TL&DR on this? I made it about 10% through and gave up looking for the point. All I see is that as is typical of such articles, the feminist administrators who mishandle these cases get written off as "academic bureaucrats".

[–]Armiel[S] 7 points8 points9 points 11 years ago (4 children) | Copy Link

TL;DR: The article details a case from Occidental College where a male student was railroaded through an extremely biased system to be found guilty of sexual assault. The problems with the case were:

1)The panel excluded exculpatory evidence for the accused, namely text messages from the accuser before and after the alleged assault indicating she consented.

2)The panel judging his guilt consisted entirely of women.

3)The 'advisor' he was allowed was from the dining staff.

4)The school found him guilty because the accuser was drunk, which they said made her incapable of consenting. However, this was not a legal definition of incapacitation.

But I highly encourage a complete read as it goes into just how absurd campus bureaucrats are at handling sexual assault hearings.

Thanks, I appreciate the TL&DR.

So did they provide any evidence that the bumbling bureaucrats were anything other than dyed-in-the-wool feminists?

It was more about them trying to please OCR, who had just threatened to investigate them for not doing enough about sexual assault. When OCR says "jump", most colleges say "how high?" out of fear that they'll get their federal funding taken away.

Of course it was. But the way I see it, OCR is a feminist office created by the crowning jewel of feminist legislation. It's basically a bunch of feminists in the federal government telling colleges to put even more feminists in charge, which they have, leading to the current state of affairs. Every other time you hear about it, the achievements of OCR and Title IX are hailed as a triumph of 20th century feminism. But now they're just nameless, faceless bureaucrats. It's important to keep this in mind because the cries from feminist activists have been to inject even more feminists into positions of power within higher education.

Another noteworthy part of the article:

A few weeks after filing with the Superior Court, in an apparent effort to show Occidental's inconsistent application of its own sexual-assault policies, John filed a sexual-assault complaint against Jane Doe with Occidental. He claimed she did not obtain his consent prior to performing oral sex on him—as he doesn't even recall this happening, and nobody ever asked Jane whether she received consent from John, he believes it should be subject to the same scrutiny under which he was investigated. (Sexual intercourse, as it's defined in the Occidental policy, includes oral sex, and there is no statute of limitations on when an accuser can file a claim.) However, because he would not meet with the university's investigator without his attorney present—just as he wouldn't meet with the investigator during the earlier investigation without his attorney present—the school declined to hear his complaint, citing his "inconsistent assertions, the timing of [his] complaint, and [his] failure to cooperate in the initial assessment process."

With Occidental refusing to investigate John's accusation of sexual assault, John's lawyer then filed a Title IX complaint against Occidental with the Office for Civil Rights in mid-October. The OCR, which receives many complaints but only commits full investigations to a fraction of them, has yet to determine whether it will look into John's case.

This is a very good strategy, I think

No, no, no. Rape = non-consensual sex + power. Since women don't have power in society, they're incapable of raping. For example, if Hillary Clinton forced a homeless man to have sex with her it wouldn't be rape since, as a woman, she has no social, economic, or political power. Educate yourself shitlord! /s

[–]Doomblaze 2 points3 points4 points 11 years ago (0 children) | Copy Link

its not called rape its called "forced penetration" so nobody pays attention to it.

Well that changed but it was like that up until 2012

"It should not be harder for a victim to prove that she was assaulted than it is for the person she's accusing to prove the assault didn't occur," explains Sokolow.

It should not be harder to prove Brett Sokolow raped murdered a girl in 2009 than it is for Brett to prove he did not rape and murder a girl in 2009. Anything else is victim blaming.

It makes it harder for a victim to prove that a male assaulted her.

Silly me. I thought that was the entire point in having a burden of proof. Better to let 10 guilty walk free than find 1 innocent guilty and all that.

The odd thing about this is that the only thing keeping the same standards from being applied to women is a bunch of bias and the general absence of an anti-female hysteria on campus. They would quickly change their tone if women were being expelled from school on trumped up charges.

Due process? What's that? Occidental is a college. They do not concern themselves with such things.
