When questioned in the police station it should be noted that neither of the accused had ejaculated during sex as a result of which the police had no forensic evidence to link either man to the sexual act, nor did the police have a complaint of rape. Regardless of this, both men gave a full account of their actions to the police. On 26th July 2011 the police charged both Clayton and Ched with rape.

Never talk to the police, it can only harm you.

Alcoholics sometimes have a very high tolerance for booze. You'd be amazed how much stuff some can put away and be completely coherent. Whether or not she could give consent... I don't know. Pulling a train on some random your buddy just picked up is farking stupid (and lets not get into going down on her after your buddy farked her....but to each his own I guess).

The fact that no rape charges were filed until she and the cops realized they were footballers should have counted for something at trial. Also, how much did these lads have to drink? No one seems to want to broach that topic. Could be that as a heavy drinker she was more in charge of her wits than they were.

More amazing than the prosecution and conviction was the denial of his right to appeal. The case had massive question marks all over it, if any case was justified in going to appeal it was this one. But there was a political appetite for a high profile white man to be jailed for rape.

And the case was beyond a joke. The "evidence" used to convict was some grainy CCTV footage that "proved" the girls level of drunkenness because she stumbled once. And this had no relevance to the consent she gave Ched.

This is one of the worst cases of someone being railroaded into jail we have ever seen. Let's hope the review of the whole affair yields some justice. Technically he can still appeal and be acquitted.

Nita Dowell, Senior Crown Prosecutor for the Crown Prosecution Service in Wales said ‘Ched Evans took advantage of a vulnerable young woman who was in no fit state to consent to sexual activity. He did so knowingly and a total disregard for her physical or emotional wellbeing'.

The case is obviously dodgy, as is the whole business of being too drunk to consent. It's like letting someone off a drink driving charge because they were too drunk to know what they were doing. Incapacitated is a whole different story, but it is crystal clear that the woman in question was not incapacitated.

Nonetheless, because Ched was convicted, people suspend their own better judgements and consider him to be guilty. I've always found this difference to legal judgement a wierd phenomenon.
