So my stbx, has been on my insurance, and dragged out the divorce because she cant function well enough to maintain a job (mental and health issues). We both signed settlement, im doing my remortgage now. So the q is if she files for disability before the divorce decree is final.. can she go after my retirement and assets eventhough we have a settlement thats been approved by the court?

And in the settlement its very clear that as of the settlement date we are completely separate.. she doesnt get any of my pension or 401k.

Her and her parents have been saying for 7 years theyve dragged this out. That she doesnt qualify for disability.. But now that she will be dropped, their hunting for anything.

The settlement also states no spousal support, and i wont seek child support.
