I want a divorce. 40m, married 8 years, 2 kids 8m 5f. I am a smart hard working guy and people tell me and I think I am a good Dad. However, I am miserable in my marriage and want to start looking into divorce proceedings.

I am the primary breadwinner and every dime I make goes towards the household. I provide all the health insurance and benefits as well. Any extra I earn doing side jobs or working OT goes to catch up on something else. I have sold my truck as I got a work truck that my boss let's me drive on weekends to save money. It still isn't enough. She started a small at home "buisness" when we first had kids selling at farmers markets but hasn't worked steady since the holidays and doesnt have anything lined up until May. Even in full swing it is barely minimum wage take home and no contributions to health, retirement, SS or Medicare. She won't get a job right now as she says she needs the time to work on her buisness for the upcoming season. It's been 2 months so far and she hasn't done anything. We got our tax returns and I'm just watching them dwindle away. I also need to do some repairs around the house that we have been putting off and that is going to eat that up.

I have a feeling when this all goes down I may be in for a rocky road as she has nothing to fall back on and will have to fight for everything she can get. She has never had any formal education or career other than H.S., and I dont think her buisness survives without the money and time I invest. I have been helping her with my time and she just uses our/my money for buisness stuff when she needs it since she started. She is not good at the buisness end of the buisness and I have been trying to help her with the bookkeeping, p&l, and to expand the buisness and make something profitable out of it but she wont even sit down and go over the finances with me and mostly brushes off my ideas. I don't know how she will pay for a lawyer either and am scared I might have to pay for hers as well.

I have not let on to her that this is the direction I want to go yet. She knows I am depressed and unhappy but I don't think she thinks I am going anywhere. My youngest starts Kindergarten in September and that will save me $1k a month not paying for preschool, so I am trying to hold out until then. I worry about my social worker S.I.L talking her into getting a restraining order the second I ask her for a divorce just because it helps her case. (I am not a violent person, I don't yell and I never have and never will give her or our children a reason to fear me). My S.I.L has spoken in the past about how every woman who is getting divorced needs to get a restraining order weather they need it or not and they should just lie about abuse to get it. I would like to remain in my home but I don't know how that works if she gets a restraining order.

I want to sit down with a lawyer and start getting my ducks in a row but that is gonna cost money up front, right? How do I stash some money away for a lawyer when there is no extra money to stash away? I have a feeling I will need my attorney from the second I ask for the divorce because I feel she is going to try and limit me from the kids and try and get me out of the house. House is in both our names but mortgage is solely in mine. Ideally I would like to buy her out and do 50/50 with the kids. I don't have a problem with fair child support but I just cant support her anymore. I also know I probably won't get what I want.

Any advice would be greatly appreciated. Also feel free to call me out on anything above. I may not be seeing this in the right light so if a different view on something might help I am all ears.
