Thank y'all for all replies....its been a little while since back here ... I've been too fricken busy it seems ... everyone in this situation is ... I could write for an hour but I won't ... All the shit is similar but different!... Mediation done.. further court dates dropped... see a little light towards end... next chapter starting... 🤔

You need some kind of separation agreement in place asap that spells out what the plan is with the house and how the equity will be split.

Good news is all the kids are adults.

If you want to stay in the house, offer to buy her out. If not, sell and get a smaller space.

Either way, get something in writing soon. If she's not contributing to the mortgage, repairs, maintenance, that will increase your equity.

just my opinion. but stay in the house as long as you can. you need to make sure the mortgage is getting paid. you don’t want your credit ruined while looking for a new place to move

but she wants to sell for half the appreciated value!

Can you pay her out what is essentially 25% of her equity then?

IF you do have to sell absolutely do not take a low ball offer from a buyer just so she gets money faster.

If you're buying her out and she wont take a low offer you need to get an appraisal that YOU hire/have done as they work for you (i.e. will go low).

EDIT: until someone files this is just a fight so do not do anything you're unwilling to do unless its ordered or already agreed on.

Keep your head up brother! I cannot say it will get better. Right now in my situation all I can handle is minute by minute. Maybe I might be able to work on hour by hour soon. You did the right thing by staying in the house. Get with your lawyer and discuss your options. You may be able to get some type of leniency with the judge. I have no clue.

Concentrate on yourself and your son/daughter staying with you. If you have friends and family lean on them. Talking about this bullshit does help. Even with us strangers on the internet.

We are all going through stupid shit. Hoping that you can work through this. Been married tp my wife for 23 years, 26 years total.
