You can't have your cake and eat it too. At some point, someone is going to move on with their life. They are going to start dating, find another partner. If I met a woman who still lived with her ex-husband, I'd run for the hills. I would expect women to feel the same about a man living with his ex-wife.

When you got divorced, it was part of the deal that individuals will do worse financially than staying together. There is a reason that divorces include custody schedules. Rip the band-aid off, move out. Otherwise you are perpetually stuck in limbo.

You'll probably end up wishing you had figured out separate living arrangements. From experience.

Who knows, maybe you two will be the exceptions, but there tends to be quite a bit of simmering acrimony and you are both setting yourself up for frequent potential situation that could and if theres alcohol around, likely will escalate trying to rehash old disputes and somehow magically solve them, thatbyou couldn't even get past when you were crazy about each other. Ymmv.

I would get my own place personally. Worth it not to hear constant angry stbx static.

What state or country are you in? The IRS states in Pub 501 (?) that if you get divorced on paper but don't actually change living arrangements (e.g. the average person thinks your married), then you are still required to file as a married couple.

Common law marriages only still exist in 16 states but they are rare and in some cases, restrictive. This is from an article that I read on the subject:

"States that do recognize common law marriage include the following: Alabama, Colorado, District of Columbia, Georgia (if created prior to 1997), Idaho (if created before 1996), Iowa, Kansas, Montana, New Hampshire (for inheritance purposes only), Ohio (if created prior to 10/1991), Oklahoma, Pennsylvania (if created before 9/2003), Rhode Island, South Carolina, Texas and Utah"
