They're just trying to get a disclosure together; effectively a snapshot of the marital holdings and debts as of a certain date (usually the date of separation). Its simply to put it in a spreadsheet and subtract the total debt from the total assets to see what's left over to split.. If the credit card has a 0 balance, or is closed. Nobody is interested

Sure, a lawyer can easily pull your credit history, and see, for instance that you paid off $40,000 of credit card debt (that was in your name) and in such a theoretical case, if it appeared to be done to hide assets and increase benefits unfairly, to you, a judge could and likely would, order you to pay $40,000 to your opponent. Would you not do the same if you were a lawyer and saw unfair actions?

Now, if you paid off $50 and closed the account, and even "got caught," that as dranic posted "nobody is interested."

Don't pay any debt off now. It will be split in settlement or divorce.

An extreme scenario would be like mine, in which my ex simply would not yield anything over in the discovery process. My attorney filed a business records subpoena to the banks themselves, and they provided 5 years of statements to us. We also filed a motion to enforce discovery, but that didn’t do too much. We got all the records through business subpoena.

Her failure to provide documents helped my case. I suggest you do whatever you got to do if they ask for them in discovery. They may not ask. If the cc is closed and gone there isn’t much to gain by getting that info. Still, be prepared that they will likely ask.
