First, I'm not in a 50/50 state. I've been married a little over 20 years, have always maintained a separate checking account, and am now retired with 1 daughter in college and a son getting close.
Since day 1, I have solely paid for every expense for our home: mortgage, utilities, taxes, etc. as well as quarterly federal and state taxes, personal taxes, etc. All payments have come from my salary and my personal checking acc't, and because my wife is oblivious to financial responsibility, she has no clue I paid the mortgage off last year. I have a pension and substantial retirement account that was initiated for 12-13 years prior to marriage, I have fluctuating rental income from property owned prior to marriage, and I have 2 college accounts that I have deposited to for my daughter and son that have substantial enough balances they will nearly pay for the kids' college expenses.
My wife has worked for about 18.5 years of our marriage and collected unemployment for the other 1.5. At one point for about 5 years, she made substantially more than I did, and even now after my retirement, she's making a decent salary. She has a small 401k through her current employer and has placed zero into our joint savings. She carries 2 credit cards with fluctuating balances that go from several thousand month over month to $0 for short periods.
Not only has she not contributed to any expense, there have been numerous occasions where she has transferred funds from my checking account into hers because she spent everything on nonsense and credit card payments. She does occasionally buy groceries and superfluous items for the home (as well as some furniture in place), but many, many times those purchases are placed on credit cards, which only turn into astronomically priced goods with interest. I'm tired of the financial irresponsibility with conversations that only fall on deaf ears, and I don't want to see my good financial standing suffer into retirement.
If I were to file for divorce as the sole financial outlet for the vast majority of everything, if anyone has similar experience, how do you believe I'd fare? Again, I'm not in a 50/50 state - things here are equitably distributed.
