So my wife and I are separated but living in the same house in New Hampshire. We've been married for 9 years and have no kids. She is currently living in my basement in an in-law apartment. She is not sure if she wants to stay in the marriage or divorce. She has agreed to do marriage counselling. We purchased our house in 2013 for 250,000 with a 30 year VA Home loan fixed at 3.25% with Wells Fargo and currently have an outstanding balance of 191,652 . The house is estimated to be worth 370,000 according to Zillow at this time.

Lately my wife has been pushing for us to refinance the house to lower our mortgage payments. She has also mentioned that if she chooses to divorce, that she does not want to stay in the house and that I could buy her out. From my perspective, in makes no sense to refinance if I may be on the verge of divorcing. My understanding is that if we divorce, I'll have no choice but to refinance because I'll be the sole income.

I guess my questions are the following:

  1. Do you think the mortgage holder would let me continue with the current loan I have? I know I would have to buyout my spouse but is it mandatory that I refinance or can I continue paying off the loan I currently have?

  2. If I choose to re-finance, is it better financially to do it pre-divorce or post divorce? If I choose to re-finance post divorce, my goal would be to buyout my wife for the house.

  3. Any other suggestions?
