Howdy, just a vent and share. I post these things for cathartic reasons mostly. So STBX (stay at home housewife, no kids, hasn't worked for 10yrs+) filed a motion for temporary support. I moved out in October and have a rental. In brief, when we were living together monthly expenses were ~$11.5/kmo. When I moved out I assumed $6k of expenses (including the mortgage). So I figured 11.5 - 6 = 5.5. I had been depositing $8k/mo into the joint account. Seemed fair, she disagreed...
She filed for Temporary Support asking for $13k/mo (that's right, $7.5k/mo more than when we were together) + $10k in legal fees. However, she didn't provide all the requested / required documents and statements. Under personal expenses she was asking for: Clothes $1400/mo, Personal $1100/mo, Recreation $1100/mo. This is NOT representative of our marriage. She also claims she can not work (fibromyalgia and chronic pain). So a lot happened:
1) First hearing got a continuance to allow her side to get more records
2) Second hearing still didn't have all records, but judge proceed to award $10k/mo of temporary support. She completed a vocational evaluation that said she can work and should make $42k/yr, but the judge ignored this stating that temporary support is just that, and that is an issue for final support.
3) Her lawyers are withdrawaling from representing her as of June 2!?! And it appears she / they have a bill of $30k!!! This is from Feb 1 to now, they have only filed one motion (for this hearing) and made no offers. I have no idea what is going on with this one?? They fired her, she fired them, who knows. The judge said since they are no longer representing her, this is a debt and not for actual representation; so did not make me pay anything for her current legal fees. She will need a new attorney and I'll likely have to pay something for that guy.
4) We are suppose to have mediation on June 13th. BUT now she doesn't have counsel; so I expect her to cancel. But will see...
She also has previously violated the temporary financial restraining order and taken $20k our of our line of credit, $7500 cashier check out of the joint checking, and maxed out the joint VISA (+$9500k). We have to sell the marital house, and I want to sell NOW while still in the best housing bubble for years to come. She has refused to even discuss it :( So hopefully she will still do mediation or maybe just be open to selling, we have ~$1million+ in equity to be divided.
So not sure what her plan is here. She is $30k in legal fees & $20k of new debt (line of credit); and very unlikely I'll have to pay anything towards those these two (the VISA and checking, is likely going to be partly paid by me). The probability of maxing out the home sale is decreasing every month she waits. In the end nothing has changed except she has more debt and potential less money for the home sale?!?
Anyway, just sharing and venting. I'm waiting to see if she is still willing to proceed with mediation. We have a court date set for Jan 3rd (in WA state it's issued 11mo after filing). Might end up just having to wait this out until a judge / arbiter orders the sale of the home.
