There are Romeo and Juliet laws but I don't think they go to 13-14 so he's screwed no matter what.

Is this a false accusation?

It's likely the parents found out, or the girl regrets it now and is revoking consent from something she'd already done. He is completely at her and the court's mercy.

Governments have adopted the theory of “social” justice. It means that certain groups collectively share guilt or innocence, usually by virtue of their color or other demographic information. In that way, it’s different from ordinary “justice”, where individuals bear guilt or innocence, based on their actions and circumstances.

If you’re a prosecutor in one of these offices, you want to advance your career. You don’t do that by prosecuting a violent psychopath who jumps out of the bushes with knife and rapes underage girls. You do it prosecuting a white teenager who had a totally consensual hookup with another teenager. Plus, you only have to prove they had sex, you don’t have to prove she didn’t consent.

If they are prosecuting him, it seems likely the law forbids that age range in his jurisdiction. The advice depends on whether they have evidence and whether the girl will testify. Sometimes, the girl will refuse. And also, there might be no evidence, as long as he wasn’t stupid enough to admit it. But I bet there is evidence. In terms of responsibility, of course it is on her parents, also, but the law won’t view it that way.

I'm not entirely sure if a pedo move, being how much of a grey zone that age bracket is. 13 is too young though, 14 iffy.

At that age they're in, 17, I'd say focus on a 17 year old.

Your friends think he is pulling a "pedo move" because he is. 13 is MIDDLE SCHOOL, 17 is senior year. That age gap is creepy while the whole thing is illegal in many places (statutory rape)

Depends on the state

New Jersey - Sex with a minor under 13 is strictly illegal regardless of age. Sex with a minor 13-15 is a crime unless the offender is no more than 4 years older. Sex with a minor 16-17 is legal if the offender is under 30.

Maryland - As long as the age difference between the couple is within three years of each other and the minor is over the age of 14, a sexual relationship will not be considered statutory rape. For example,a 15 year old sophomore and an 18 year old senior are protected by Romeo and Juliet laws.

But lots of states don't have any Romoe & Juliet laws. In most states this is probably illegal.

We definitely don't have enough information and context here to know if it's a false accusation or not.

Laws about age of consent vary from state to state, and country to country. In some places the age gap could be legal, and in others it could be illegal. A 17 year old dating a 13 year old is, at the very least, a bit of a creepy age gap, if nothing else. Anything more than a couple years, either way, is problematic, but may or may not actually be illegal. I wouldn't necessarily call it a "pedo" thing, as the guy's still pretty young, and some 13 year olds grow faster than others, but of course everyone's going to assume the worst because people in the internet age are allergic to nuance.

Moving on, even if the girl was able to consent according to the local laws, it's not really clear from your post whether this is a case of statutory rape, or rape-rape. Like, even if having consensual sex was legal, if she's saying she was rape-raped, then it's still a pretty serious allegation.

But then, if there is the question of whether those allegations are true... That's probably something the police need to figure out.

It could definitely be true, and her allegations definitely should not be dismissed out of hand. The police should conduct a through investigation, gather the evidence, and take it seriously. Scumbag teenagers exist, and this guy could potentially be one.

But also, given her age, and what little we know about the situation, there's definitely a strong incentive for her to make up the allegations too. Adolescents are cruel, and if a girl that age gets outed as being sexually active with a waay older boy, she would end up getting slut-shamed, hard. But, if she were raped, instead, all that would change, and she'd get sympathy, rather than scorn from all her friends and parents.

But also, even if it was consensual, a girl that age being sexually active at all, is a bit of a red flag that authorities or social workers should look into. This is a bit anecdotal, but the only girls I met in my real life who were having sex at that age, later confided in me they had been sexually abused by adults. Nobody knew, or nobody believed them at the time, but the early start to their sex lives wasn't something that happened without outside influence.

Assuming there is something illegal going on here, the final question is whether to try him as an adult or not. Honestly, unless this kid is an absolute unrepentant sociopath with a well documented history of doing fucked up shit, then I don't think it's fair to try him as an adult, especially not if he's only guilty of a technicality like 'statutory rape,' rather than full blown, actually violent, rape-rape. It's pretty hard to know what's reasonable here, without knowing more details about the situation, or even what's being alleged. Hopefully, the judge will take the guy's young age into account when sentencing though.

Dear knows. I wasn't there to witness it.

She was there. Maybe he was too. Maybe there's quite the evidence to back her claims ... or not. Who knows. But yeah, she's under 18, law presumes she can't consent (and likewise for him). So, if someone had sex with her ... that's generally trouble. Now, as to what does and doesn't get prosecuted, and when, and where, and under what circumstances ... that's a whole 'nother can of worms.
