I have first hand experience multiple times of it. You should DEMAND the following: 1 when the child is with you, you don't pay child support 2 visitation is every Wednesday and every other weekend 3 split holidays equally 4 you must be notified at least 90 prior if she plans on moving. If you allow the move she is to pay to get the child to you and you pay to get back to her. 5 child should not leave state without you being notified of not only where but for how long 6 summer vacation time ... half and continous days 7 your birthday

The ONLY thing that a judge may balk at is the Wednesday visitations. Not sure why but that's been my experience. And lastly, terms mean different things in different states. 50/50 can mean equal visitation but the mother can be given physical care which essentially means you don't have shit for rights when it comes to decision making. If physical care is a thing in your state you need to fight that tooth and nail.

I got 50/50 25 years ago of a 9 month old in California.

One piece of advice, don't criticize the mother of your child unless it's really endangering your child. I was told that by a judge in open court. He said if I had called her a bad mom he would have given her full custody.

You want to co-parent and help each other after this.

Be the reasonable person..

When you think she is being unreasonable.. don't stooped to her level. Always make sure you're putting the kids best interest first

I'm in Texas. I currently have 50/50 physical custody of my 13 year old son. She still has legal custody. It was 70/30 (default) until my son turned 11. But I was ok with it because she let me see him whenever I wanted, which was about half the time. And child support wasn't unbearable.

I'm not sure what changed, but when he turned 11 she would only let me see him per custody agreement. My work schedule changed from the 10 year old prior agreement, so very little time. Then she claimed abuse to muddy the water. Then she sued me for more $$, basically so I couldn't fight case.

I got an attorney. Disproved abuse, easy with no evidence. Was granted 40% physical, no legal and double child support.

Then went back for 50/50 physical and legal. They offered settlement. Agreed to temporary 50/50 physical custody, no legal custody, slight reduction in child support.

Son, now 13. Very vocal about wanting to live with me. Told his mom. She flipped out. Her attorney called mine and wanted to make 50/50 temp orders permanent, still no legal custody and keep child support. I'm currently fighting for primary physical and legal custody. My son interviews with the judge in 3 weeks. I'm optimistic within reason.

I've owned my home in a good neighborhood for 10 years. I make 3x more money. I spend more time with him and attend all his extracurriculars: football, track, baseball, band. We workout and practice sports together.

During the same 11 year time. She's been married and divorced 2x and had 2 other live in boyfriends. Lived 4 different places. Her parents enable her poor behavior, and pay her legal bills. I never married her, but her 2 ex husband's are getting the same treatment. Her attorney stays busy.

Moral of the story is to get an agreement that works for you in the beginning. It's hard to change the agreements. They'll give you some of what is fair, but not all. You might have to take it in pieces as you go. These women and their families act like kid's don't need a father, except when the bill is due.

Good luck, hopefully your child's mom and her family are reasonable. And you get fair treatment.
