Caleb Warner is a 24-year-old man from Fargo, North Dakota who was expelled from the University of North Dakota due to a false allegation of sexual assault that was filed against him while he was a student there. There have been a few reddit discussions about this case in recent days, but I think it deserves to be kept in the public eye. When I first saw something about this case a few days ago, I didn't pay much attention to it. But earlier today, someone posted a link in a comment about this case and I started reading more about it.

On December 13, 2009, Warner had what he has maintained was consensual sexual relations with another University of North Dakota student, a female from California who has remained unnamed to this point (even though she has a warrant out for her arrest). At some time between that sexual encounter in December 2009 and February 2010, the woman reported an allegation of sexual assault to the university and to the Grand Forks, North Dakota police department. The University of North Dakota is located in Grand Forks, North Dakota.

A hearing was held for Warner at UND on February 11, 2010. He was informed on February 16, 2010 that the university had found him guilty, and he was expelled from school.

Then three months later, the Grand Forks police department, after having done an actual investigation, concluded that the woman who accused Caleb Warner of sexual assault was in fact making it up. She lied. It never happened. The police were so certain that she was lying, that they got the Grand Forks County district court to formally charge her with violating section 12.1-11-03 ("False information or report to law enforcement officers or security officials") of the North Dakota Century Code, and issued a warrant for her arrest. The warrant has been outstanding for more than a year, and the woman has failed to appear in court. She returned to California.

Caleb Warner was never charged with any crime. He was never arrested. His accuser has a warrant out for her arrest for filing a false report to law enforcement about the made-up sexual assault.

But the University of North Dakota doesn't care. They refuse to even re-open the case. They expelled a male student on the basis of nothing more than one woman's accusation, an accusation that was not supported by any evidence whatsoever (if there had been any evidence of a sexual assault, the police would not have been able to charge her with filing a false report and put a warrant out for her arrest).

I have been thinking about what this means. I think this is bigger than one case and one university. This is something that could, and probably does, happen all over this country at numerous colleges and universities. There are people doing work on this case. One group is the group FIRE, which stands for Foundation for Individual Rights in Education. Warner contacted them and they are doing work on his behalf, trying to get UND to re-open the case.

One of the things that FIRE has said is that recently the Department of Education has imposed new standards on all colleges and universities that receive federal money, which mandates that these colleges use a lower burden of proof in sexual assault cases (a so-called "preponderance of the evidence" standard). This is the same type of standard that UND used to declare Caleb Warner guilty. It means that when a woman goes to the university and says that a man sexually-assaulted or raped her, that unless there is some completely damning proof that she is lying (such as an actual video tape of the incident that proves that she is lying, which is not going to exist in 99.9% of cases), the university MUST assume that it is more likely than not that she is telling the truth and that the rape or sexual assault occurred. There is basically no way for the man to prove that it didn't happen unless he has some kind of completely damning evidence such as a videotape. Otherwise, the university is going to assume that it did happen and they will declare that man guilty and expel him, just like they did to Caleb Warner.

Remember, this is an actual federal policy that exists in this country now at nearly every college and university. All it takes is a woman's accusation of rape or sexual assault to get any man expelled from college and have his future and career prospects ruined. Just an accusation. These colleges are REQUIRED now to believe her ACCUSATION. And as you can see with the Caleb Warner case, the universities don't really conduct an investigation. Defendants have to defend themselves in court. If witnesses don't like a question, they can just say "pass" and not answer it. And then when actual investigators investigate the case, such as when the Grand Forks police department investigated the accusations against Caleb Warner, the university doesn't really care about the police findings either. They won't re-open the case even when actual police investigations prove that the entire case was made-up. All they care about is, "we followed our protocols". And those protocols instruct them to always believe a woman's rape accusation, and to expel any male student who is accused of rape or sexual assault unless that male student can prove conclusively that the rape or sexual assault did not happen (which most men will not be able to do, because most men do not videotape their sexual encounters).

If you are a male and you are in college or you know someone in college, remember: the ONLY thing keeping this from happening to you or to those whom you know, is that a woman has CHOSEN not to use this power against you or against people that you know. Other women choose to use this power against men, either out of spite, regret for having sex, vindictiveness, schizophrenia, you name it. The reason is as individual as the woman perpetrating the act. One has to wonder, how often this does occur. And how often this will be occurring in the future. This new preponderance of the evidence standard only just took effect. Because remember, most of the time that this occurs it will not involve a subsequent determination of a false accusation by police. If a woman was smart, she wouldn't even report it to police, but just to the university. That way, the university would expel the man, but not have the resources to do a proper investigation, and no one would ever know the truth. The man would just be another statistic on the college's crime stats: "expelled for sexual assault". Caleb Warner could have been one of those statistics that no one ever heard about. But in this case, the woman went to the police and the police were able to prove that she was lying, and that's why his story became news.

Another thing to remember is that the University of North Dakota is a public, taxpayer-supported college. It is the flagship public university for the state of North Dakota. Some would say that the same standards of our judicial system should not apply to colleges, that colleges should be able to impose their own standards on their students, even if those standards infringe on the rights of defendants. I don't see how this should apply to public universities. If it does, then it's wrong. These are not businesses, they are public, taxpayer-supported institutions.

Read up on the case of Caleb Warner. Those of us concerned about men's rights are not just a bunch of "whining men who are angry about losing our privileges due to feminism". There are serious travesties of justice that are occurring daily in this country to men because of their gender. What happened to Caleb Warner is a perfect example of it.

You can see from the police report that numerous witnesses contradicted the false accuser's story. The accuser was seen making out and even having sexual intercourse with Caleb Warner. Yes, that's right. A witness told police that he saw Warner and the woman having sexual intercourse on the night of the alleged rape. The accuser sent a text message to Warner telling him that she wanted to have sex with him days AFTER he supposedly had raped her. Warner's roommate told police that he saw the accuser the morning after the alleged rape and she joked with him.

So there are the findings, for anyone concerned about how police determined that this was a false rape accusation.
