The way I see it, the rights of the accused are more important than the rights of the accuser. It's a fundamental rule logic that someone with the positive claim is responsible for producing evidence it occurred, since proving it didn't is nearly impossible.

Add to this the fact we are talking about taking periods of life away from a person and it becomes unconscionable to even entertain the idea the accuser should be treated in an extra special manner up to and including removing the burden to prove one's claim.

Anyone claiming rape should go through whatever process we have to ensure they are not lying. If that means a rape kit, then fine. If that means a polygraph, fine. If it means the cops grill you for 12hrs straight and pull your life apart, fine.

That's due process. I would expect and accept no less for anyone.

At some point in time, I think the late eighties, we started down this path of 'victim's rights'. Which is fine, but you're not a 'victim' until it's proven and your rights do not supersede due process until said process has occurred.

The idea is that if you question victims, or put them through polygraphs, many consider it victim blaming. On the other hand, you have to be able to expect something from the victim. On the side of the accused rapist, how do we make sure that they don't suffer undue punishment if they are innocent? How do we ensure that they are punished if they are guilty?

Which is bullshit. If a person wants to press criminal charges against another citizen, then they need to prove their case. If they don't want to go through that, then they can go to therapy and not deal with the court system.

Agreed.

Launching an investigation that looks at all applicable facts is not victim blaming.

People that call it that tend to not have any reverence for justice, or simply do not understand how justice works.

I think that having a feminist debate board is a contradiction in terms.
