Talking about unsolicited dick pics instead of unsolicited nudes and porn in general is a serious problem of gender bias in the law. Men may be more at fault for this, but a law against a specific set of people sounds a bit dangerous doesn't it?

A BILL TO BE ENTITLED

AN ACT relating to the creation of the criminal offense of unlawful electronic transmission of sexually explicit visual material.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:

SECTION 1. Chapter 21, Penal Code, is amended by adding Section 21.19 to read as follows:

Sec. 21.19. UNLAWFUL ELECTRONIC TRANSMISSION OF SEXUALLY EXPLICIT VISUAL MATERIAL.

(a) In this section, "intimate parts," "sexual conduct," and "visual material" have the meanings assigned by Section 21.16.

(b) A person commits an offense if the person knowingly transmits by electronic means visual material that:

(1) depicts:

(A) any person engaging in sexual conduct or with the person's intimate parts exposed; or

(B) covered genitals of a male person that are in a discernibly turgid state; and

(2) is not sent at the request of or with the express consent of the recipient.

(c) An offense under this section is a Class C misdemeanor.

(d) If conduct that constitutes an offense under this section also constitutes an offense under any other law, the actor may be prosecuted under this section or the other law.

SECTION 2. This Act takes effect September 1, 2019.

I’m going to say that sending unsolicited nude photographs to others is akin to flashing someone and should be held to the same standards. However, breast feeding is not a sexual or enticing act. It is literally feeding a child. Let’s not have everyone ripping off their tops and breast feeding in a restaurant. But I have seen plenty of women, my wife included, that can nourish a growing child in a respectful and dignified way.

It isn't reasonable to equate images of breast feeding with sexually explicit images. Breast feeding is natural and of great benefit to mother and infant. We should be encouraging breast feeding for women who are able.

In the UK the age of consent is 16. However the law stipulates that you cannot have nude pictures of people under 18. We have heard of cases where 18 year old men have been arrested and charged for having pictures of their 17 year old girlfriend. These pictures were taken by the girl, and she sent them to her boyfriend. He did not share them with anyone, but, when arrested or searched for an unrelated matter, the police have found the images and prosecuted. However we are yet to hear of a female being prosecuted on a similar basis, or of one being punished for sending unsolicited pictures.

It seems that a consensually sent image, let alone an unsolicited one, can have far more serious consequences for a man than for a woman.
