Ignoring the moral/ethical issues of age and mentoring for a moment... the legal issue here seems to hinge on her employment with the school. If, as an assistant coach, she had disciplinary authority over any student, and not just the cheer squad, then regardless of the age of the student, or the absence of the fact of being a direct supervisor, she would still be deemed in violation. A similar situation can be found in small retail outlets like corporate-owned gas stations in which the corporation has an anti-fraternization policy for management. If the manager of one gas station fraternizes with a cashier from another, she is still in violation of the policy, even though she is not that cashier's direct supervisor, because she does have the authority to sanction the employee or influence the employee's direct supervisor.

In the case of a gas station, the employer is unlikely to pursue action unless there is a complaint. This is where it's different with a school. Educators and other authorities within a school setting have a greater level of responsibility and culpability than gas station managers because school authorities are in part responsible for the well-being and personal development of their charges. They aren't just bosses. They are shaping influences, in some cases with controlling authority which can affect the student's whole future (as when the student's psychological response to interaction - or the teacher's response to personal feelings - affect grades enough to damage college admission, scholarship, and grant eligibility.)

In addition, a gas station attendant may seek employment elsewhere. While that may be a challenge, and does not preclude deeming harassing behavior by a manger to be harassment, employment is a voluntary arrangement. Students in public schools, on the other hand, may be considered to be there involuntarily. Being able to go to another school is not an automatic. Failure to attend can result in truancy charges, and dropping out affects employment prospects.

Because of that increased level of control over the lives of their charges, regardless of the moral/ethical issues, the law does need to hold school authorities and other caregivers to a higher standard than it does individuals working in non-care fields.

She really shouldnt be prosecuted. He is of legal age, and she didnt even have power over him (as a cheerleading coach, an assistant to boot).

Besides, I think that whole "power over..." thing is BS anyways. Being of legal age should reflect being ready to be a parent, something which is a giant decision that will majorly influence 1/3 of your life. Surely, someone who can make that kind of decision can decide if he wants to sleep with a teacher or not.
