While negative reinforcement such as physical impact on your child can have negative impact if done in excess.

Studies have shown that in fact it can be positive for the child. It is similar to "rough and tumble" play; where a child needs to know their boundaries of what is right or wrong. Discipline most call it; but it is one way of protecting your child from an early stage in life that certain behaviours can cause *pain*. Which is a far more effective and direct method in preventing future behaviours.

While I don't support child abuse, majority of western children are now completely out of hand due to the lack of 'pain' felt during their early stages. Comfort can be poison; and due to the lack of repercussions/punishment gone through in their early stages in life, they often tend to suffer later due to their seemingly obnoxious+daring personality which seems to think that nothing will happen to them - since they have gotten away with it their whole life without issue.

EDIT:Rough and Tumble play is effectively empathy building from early stages. Knowing what hurts you; likewise can hurt others.It is only when you know pain, then can you develop a sufficient amount of empathy/self awareness about your own behaviour.

I hope you actually mean that or your kids will become loud mouthed brats. Kids are not smart. Boys especially need to understand authority. If your kid doesn’t respect you he’ll never listen to you and boys understand strength most of all. Good parents never have to beat their kids more than twice in a lifetime. First time is when the kid crosses the line for the first time and tries to test your patience. Second time is when the kid grows up to be a teenager and thinks he can take you on now and do whatever he wants and this is the crucial one. You cannot show weakness and if you properly do it he’ll never ever cross you again simply because of the fear of getting smacked. My mom never had to smack me more than 5 times I think because I was a wild kid but I was abused by my dad and beaten up on cooldown sometimes for no reason other than him having a bad day. He made a hobby of it so trust me I’m not talking out of my arse and I don’t wish my childhood on anyone. I vowed to raise my kids right because after loathing my dad for so long I realised that parents who never beat their kids 9 times out of 10 end up with unadjusted children.

Also EDIT: I’m not saying everyone should be beating their kids. That’s a last resort. However kids when they grow up will test your patience, and if you don’t act appropriately they’ll think it is the norm and will apply it elsewhere thinking there are no consequences involved.

The best thing you can do to your child is teach him/her that bad behavior/actions comes with consequences. Teach them this early on so they are FAR less likely to repeat it during their adult age where it’s too late and gets you arrested.

Majority of today’s criminals comes from single parent house holds. Often raised by a single mother with low authorative relation with her child. This child, not having a father figure does not develop the necessary behavior of “respect”/ right levels of empathy to properly understand what certain behaviors are right or wrong. If the kids were taught respect early on, as well as undergone right levels of rough and tumble play you can significantly reduce antisocial behaviors. Thus reducing any chances of becoming future criminals.

The virus is not an imminent threat, someone coughing on you has not generally been held as a reason to use force against someone, if you are aware of case law that saws otherwise, I'm happy to change my opinion. (missing element 2)

Second, while she was the aggressive one she did not attack (missing element 1)

Third, he clearly was not in fear of being injured, and given the situation, I find it unlikely a jury would decide any fear he claimed was reasonable (missing element 4)

Fourth, even if we were to concede, in arguendo, that it was reasonable to fear and he was in an imminent threat of bodily harm; the level of force used is over an above the amount needed to pacify the situation. Much like using a knife against someone who punched you isn't self defense because it escalates the level of force used, punching someone in the head is often not a proper level of force for someone shouting at you. (missing element 3)

Given the totality of the weight, it seems like the odds are highly against it being self-defense.

That said, as per the article covering it, while he was arrested and cited they have not decided whether he will be charged or if a self-defense claim is likely to be successful. So even if you are correct that this is self-defense, this still isn't a pass because this is what they do for pretty much every case of assault and self-defense.

PS: If California was a duty to retreat state, you can see then entire back of the train and other passenger cars that you can move to in order to retreat. California, to my knowledge, is not a duty to retreat state however, so that discussion is moot.
