Yup, in Canada here there's been cases where prenups have been thrown out of court because the woman claimed that she had a glass of wine before she was given the prenup to sign or that she was under the threat of violence.

If a woman truly wants a prenup torn up it will happen.

For this reason most lawyers will advise you that "that bitch gets nothing" prenups can be drawn up, but aren't your best bet at actual asset protection. Your best bet is something like A) assets earned prior stay seperate, assets gained during the marriage (or growth on assets owned previously) is split at some rate that is pretty fair to her. And your prenup should pre-emptively include some alimony with limitations on for how long.

A good prenup is one that doesn't "fuck her over" but rather still is more than she should get by any sense of ethics. Because the "I got a prenup that bitch gets nothing" is too risky - better to pay her 20% than try to pay her 0% and get it thrown out and defaulted to 50%.

20% given is not asset protection. It’s only a form of damage control. The lawyers might be correct in how the outcome would be, however, a signed prenup should stand on its own and not be able to be reversed. If this is that case then I should be able to default on loans and get out of it because I had a beer before I signed.

Who gives a shit about "how things should be" certainly not the court, certainly not her lawyer, certainly not the government. "A signed prenup should stand on its own" -> Obviously, but that's not the case. "If this is the case then I should be able to default on loans and get out of it because..." -> OK you try that defense.

Practicality and pragmatism. Avoid the assrape by drafting a prenup that isn't toilet paper - I'd rather have as many of my franklins as possible at the end of the day instead of quoting Franklin idealistically.

Prenups are different. In that case you have an enormous amount of law and precedent, namely marital law, on the other side of the conversation. Same goes for child support issues. There are some things that cannot be contractually waived by statute and so on.

But when it's two people freely associating with each other without the burden of marital law precedent it's pretty hard to see a scenario where a relatively clearly drafted contract between two adults wouldn't be upheld as a matter of course.

If you don't have something formal stipulating the rules and expectations of a guest, such as formalizing them as a tenant, then you could be SOL if they break anything or squat or whatever at your place or one of your rental properties.

There has to be a contract of you're leaving yourself wide open to any damages they commit on the property or to others. In Cena's case he did the opposite in a sense by severely restricting her access and rights to his properties by formalizing her as a guess and that she'd have to vacate the premises if certain criteria were met (eg if they break up). Without this agreement she could claim his place as her place of residence and he'd have to get police and the courts involved to have her removed.

Some areas have such extreme common law marriage laws, that if she had provided literally anything toward the property (money or repairs), half of the residence becomes owned by her after as little as 6 months.

Your estate lawyer should already have these standard contracts ready to give you. I never use my Illinois contract for my Florida property, though. Different address, different contract.

Well, a quick Google search (YMMV) says:

"In order for a couple to have common-law standing in Ontario and Manitoba, they must be living together in a conjugal relationship for three years or more, or one year with a child."

Wikipedia has an entire section on common law relationships in Canada. Quebec has "conjoints de fait" (de facto unions) defined.

My old divorce attorney is the guy I rely on now to protect my assets. I am very, very careful with my assets -- no amount of sex with no amount of HB is worth giving up my rights to my assets.

Definitely depends on the province.

For example, in Nova Scotia you need to submit documentation to be considered common law, in Quebec I don't think there's any such thing as common law, and in some provinces (BC I think, probably others) you're automatically common law after 2-3 years.

yup, plus the Fed GOC only recognizes with documentation, and anglo laws don't apply to quebec. It's the first I've heard of their regale du conjoint that Abdada talked about, so I'd have to look into it more.

Having said that, the legal protections in place are probably different as well. Courts only need arbitrators, not lawers, and they uphold whatever arrangements you make out of court. Children are the only runaround, but I'd have to look into those requirements to be able to say.

Closest I've come to studying the law on custody is knowing that kids of a certain age can pick their own primary guardian, and that it's been bad enough that some guys expatriate over their ex wives weaponizing the children. e.g. David Foley

If you have an estate, you should have a lawyer at least meeting with you once a year to discuss changes and directions. Since most people are below worthless (meaning, less than $0 net worth), there's no point in explaining this to them as they would likely gain something out of getting fucked by a partner with a positive net worth.

Are you a lawyer? This sounds pretty goofy to me. My lawyer (for almost 20 years now) has a lot of standard agreements I use with others when we're not talking about specific relationships that need defining. My landlord-tenant agreement hasn't really changed in 25 years other than adding a few contingencies that I came across myself and got his approval on.

Unless your two states happen to be a common twinning with lawyers who are licensed in both states. There are a LOT of lawyers and legal groups licensed in both Illinois and Florida, for example.

Dependant on the country of residence. In the UK if you own a property and have a GF move in where she pays rent, utilities etc. If she signs a tenancy contract she is classified as a tenant by law, and it currently superseeds the common law arrangment. I know a few succesful guys who have done this so they don't lose anything if/when it goes south.

I love the bullshit attempts at emotional manipulation she is quoted saying. Same bullshit my ex tried when I told her I have no interest in getting married or getting a place together. Women are constantly trying to push for a "lockdown" method and once they believe they have it all their "effort and love" goes out the fucking window.

Never give closure, never give unreciprocated commitment, and never allow yourself to be locked down to commitment while they have a free reign to bow out when they feel like it.

It was a tenant agreement. Stipulated she only had guest access if they dated thereby protecting his property. Without such an agreement she could claim his residence as her own and police would not be able to remove her for trespassing. Instead he'd have to get the courts to evict her like a squatter.
