During course of separation, STBX moved to her parent's home and we enrolled kids in school out there, 2020 fall. It was only option for in-school, during early stages of pandemic, allowing us both to continue working. We have since sold martial home (Oct 2021)

I have been living near metro area since, to be within 10-15min to my work (15 yrs). I'm fighting for shared custody, and expect to get it, as I now have a residence where kids are in school. Neither of us want the current situation (65+ miles from my work), but she wants a suburb that is still 45+ minutes away.

What factors matter to the court? My guess is, if we can't agree, the court will keep kids where they are... Looking for input. Better schools, shorter commute allows me to be more involved with extra curriculars and social development. Kids are 9 & 11. My SO is closer to my work as well, and her support would be meaningful. Same for my brother's family. STBX only connection send to be her SO. She has been unstable with work, starting a new job again last month.
