They should at the very least have the decency to call it "statutory rape".
[–][deleted] 18 points19 points20 points 8 years ago (8 children) | Copy Link
Indeed. Age of consent in Georgia is 16. The boy is 15. There was no "relationship". It's straight up statutory rape.
[–]SunshineBlind 8 points9 points10 points 8 years ago (0 children) | Copy Link
Precisely. Doesen't matter if it was consensual, even.

Ages of consent in the United States
In the United States, age of consent laws regarding sexual activity are made at the state level. There are several federal statutes related to protecting minors from sexual predators, but laws regarding specific age requirements for sexual consent are left to individual states, territories, and the District of Columbia. Depending on the jurisdiction, legal age of consent ranges from 16 to 18 years old. In some places, civil and criminal laws within the same state conflict with each other.

Of course the 1 state I care about has no data available. But I think it is 17 in tx.

[–]mwobuddy -1 points0 points1 point 8 years ago (1 child) | Copy Link
So in 24 hours, it would'vebeen a relationship?
[–][deleted] 0 points1 point2 points 8 years ago (0 children) | Copy Link
Look, you wanna argue on the philosophy of the law regarding age of consent, I'm all for it. I actually agree that the number is completely fictitious and means nothing from a biological standpoint. However, the law should be followed as it exists, not as it should be. So, until the law changes, that's the law. If a male teacher had sexual relations with a female student of that age, very few people would engage in a philosophical debate.
[–]rg57 0 points1 point2 points 8 years ago (1 child) | Copy Link
The decent thing to do is to describe the relationship as the people involved see it. (And since this is just a screenshot, conveniently we don't get to know).
As a gay man, I certainly wouldn't want my arrest (for sex with my husband) referred to as "committing the unnatural act of sodomy upon each other", which it would have been just a few years ago.
There's no reason for bad law to dictate reporting.
[–]SunshineBlind 1 point2 points3 points 8 years ago (0 children) | Copy Link
I honestly think there's a huge difference between what consenting adults are up to/feel, and what a, what, 15year old might think at the time. Especially if the older part is said younger parts teacher, and therefor in a position of power.

'Relationship with'. They mean like black people used to 'have relationships with' nooses? Like Jews 'had relationships with' Nazis?
Sorry if this analogy causes some people offense but its RAPE excuses for pretty women we're talking about, and powerful institutions are sending the message to our kids that it is not only OK, but almost to be ENCOURAGED when boys are the victims and pretty women the rapists. Yes I'm angry and sickened, and I won't hide my anger.

No, its not rape. If he consented, it can't be rape.
It may still be illegal. It may still be immoral or unethical, but it isn't rape. To equate it such it so assume that a free and willing agent of sexual contact is identical to someone who's been tortured by captivity, drugging, threats of or actual use of violence, into a sex act they hated and feel damaged by immediately after.
That's kind of a shit thing to do to real victims of rape, to say their trauma is no worse than a willing act.

In this link I provide references to laws in other states wherein a 17 year old having sex with a 14 year old boyfriend or girlfriend is violating statutory rape and could get 40 years for a male, and 9 months for a female. It also says that if two people are 14, they are both criminals, although we know for a fact the male will be solely charged in most cases.
I explain this position here: https://www.reddit.com/r/MensRights/comments/6txggz/so_baker_seems_to_think_that_although_according/dlop3i5/
Its because we view the male as the sexual aggressor damaging the female, similar to how we view adult as sexual aggressor damaging the 'child' (which is really the person who is underage, but is NOT a child in any biological or psychological sense, and is NOT prepubescent which is the acid test for pedophilia).
Here's the example of 14 and 17 year olds having sex: https://www.reddit.com/r/MensRights/comments/6tv4uy/dear_fox_news_its_assault_or_rape_not_romp_middle/dlo5a90/
Note the male gets a possibility of 40 years for being 17, the female gets a possibility of 9 months.
Here's some more arguments: https://www.reddit.com/r/MensRights/comments/6tkdn0/woman_who_began_grooming_and_raping_boy_since_he/dlo15t0/
https://www.reddit.com/r/MensRights/comments/6tkdn0/woman_who_began_grooming_and_raping_boy_since_he/dlnz80u/
Here's feminists demanding the age of consent be 21, to be set with other 'milestones' in females' lives back in the 1800-1900s. They considered a 21 year old female 'still child-like in mind'.
Which is what people who are angry about this particular subject say when they talk about how this was rape because he's 15 (or 16, or even 17 if the age of consent is up to 18 in some fascist state).

You can clearly see the denouncing of teenage + adult sexuality as pedophilia, by so many supposed educated people. Now, why are they calling it pedophilia when it does not fit the definition? An ideological goal, perhaps?

Foucault observes that whereas the law formerly condemned the infringement, the act of breaking the law, we enter from now on in a disciplinary society which condemns the criminal himself – called "delinquent" or "pervert" – and instead of punishing the act, we criminalize a person or a category of the population. Hocquenghem sustains that "a whole mixture of notions" is responsible for the fabrication of the idea of the crime against decency, ranging from religious prohibitions concerning sodomy to the separation between the world of the child and the world of the adult. He observes that this was possible due to the creation of a category of people regarded as "perverts", "legal monsters" whose aim in life would be to practice sex with children. They would then really become intolerable perverts since the crime as such is recognized, and reinforced by a psychological and sociological arsenal.

Yes, its the creation of a danger class, and the initiation of a witch hunt. We've always had people we used as scapegoats for the ills of society. "If we just burn that witch, kill that capitalist, gas these Jews, then our society will be whole, pure, complete, etc".
Admittedly, there are limits. Someone having sex with a 9 year old is clearly beyond the pale and should never be allowed. It is essentially rape at that point.
But we're talking teens here, who fuck like rabbits with each other.
Here we draw the concept that age of consent in of itself is what delinates willing sex from rape into absurdity. It uses a much longer version of "so a 16 year old is a rape victim in california but unharmed in nevada purely because of laws in the local area?" argument.

More, possibly redundant, info on suffragettes wanting age of consent raised.
https://www.reddit.com/r/MensRights/comments/6tfeyz/if_feminists_were_honestly_trying_to_get_equality/dlme7n0/
You'll note that when they want age of consent raised to 'protect girls', it comes from the idea that female sexuality is both highly valuable and also highly at risk, whereas male sexuality is neither valuable nor at risk, which is why it wasn't until THE 1970's that the age of consent laws were made gender neutral. Women did not consider "underage boys" victims, and men didn't either.
The entire point of these laws is considering one individual the 'primary aggressor' of sex, and the other the 'victim' so it falls perfectly in-line with feminist ideology of sex being a power struggle, and males abusing females. Rather than it being a cooperative event where two people get themselves off through each other, its a form of combat.
If its like a form of combat, then the idea that we should only allow people to "punch across" to those who are of "equal skill level" makes sense.

In Georgia the age of consent is 16 years old. The boy in this situation was 15 years old. That is statutory rape. Statutory rape is still rape.
[–]mwobuddy 0 points1 point2 points 8 years ago (2 children) | Copy Link
So a 17 year old in Florida or California is a victim of rape when they sneak out to go blow their boyfriend of either 18 or 40 years old? Cause the law clearly says it was rape, therefore it is.
You know what else the law claimed in the past? That slaves were property and not people. Therefore because law said so, enslaved blacks weren't actually human beings.
It must be hard living a life where everything the law says is inherently factual.

And slave owners took advantage of slaves. What's your point now? Its funny. You know, I equate these two things and that seems to have some kind of moral indignation from you but people equate two dissimilar behaviors like willing sex and actual rape and call it the same thing, and no one cares.
[–]IronJohnMRA -1 points0 points1 point 8 years ago* (2 children) | Copy Link
You mean rape, right?
They would, but rape is actually harmful and clearly the writers don't think a 40 year old women could do anything to hurt a 15 year old boy. Besides, he probably enjoyed it, in their thinking, and was lucky to have the experience. Where's the harm in that?

As much as I would have loved to have done this at his age, should she have gotten pregnant, he's not ready to be a parent.
He's just as vulnerable as a 15 year old girl having sex with an adult, both are not mentally and emotionally ready for it.
This woman took advantage of his developing hormones and she should know better.
Sad thing is that if she had gotten pregnant, the boy could've been held responsible for child support.

Would you ask this question of a 40-year-old male teacher having sex with his 15-year-old female student? Consent is immaterial to the charge of statutory rape.

Would you ask this question of a 40-year-old male teacher having sex with his 15-year-old female student?
Yes. And that is my point. We need to stop demanding that women be punished as harshly as men for consensual sex and start demanding that consensual sex not be punished.
[–]tharkyllinus 4 points5 points6 points 8 years ago (12 children) | Copy Link

Because the post by /u/tharkyliinus seemed to indicate that underage individuals are incapable of consent. Pointing out that no one pitches a fit when they're consenting to another 15 year old means that everyone recognizes that 15 years old actually are capable of consent.

There was a time when the law told Rosa Parks to sit in the back of the bus. We got that ridiculous law changed. Rather than trying to get more people locked up for longer periods in overcrowded prisons for having consensual May-December relationships, we should look to modify the laws.
[–]Rethgil 1 point2 points3 points 8 years ago (1 child) | Copy Link

Oh, gotchya. Back in 1955 we had some bad laws that needed changing. But now we've got that all fixed right up and all our laws are perfect now! Cool.
So if the age of consent was reduced to 14 tomorrow, would it no longer be rape?
It surely can't be such a serious offense if your definition of rape hinges on purely legal status and not on the actual actions taken.
Is a 17 year old a victim of being raped in Florida and California where the ages of consent are 18 there, but not a victim of being raped in Nevada where the age of consent is 16? Or in UK, Canada, France, Australia, etc?
By adhering strictly to age of consent/statutory rape law, you're suggesting that a 17 year old is a victim of a traumatic and painful experience in California and Florida, yet is fully capable, understanding, and able to agree to sex in Nevada or the UK.
Those are some damn magical state division lines which can distort the mental capacity of a 17 year old just by being born in or crossing from one state to another.

[–][deleted] 3 points4 points5 points 8 years ago (1 child) | Copy Link
So that adults can take advantage of you kids that don't understand the ramifications of their actions?
Of course not. There still needs to be meaningful consent, of course. Just like you need meaningful consent if you're going to have sex with a 20 year old, 25 year old or 50 year old who doesn't understand the ramifications of their actions.
[–]Mythandros 1 point2 points3 points 8 years ago (0 children) | Copy Link
Consent doesn't matter when you are raping someone who is legally unable to consent. It doesn't matter if the boy consented or not, this is rape. How can you not see that?
