Wow thats a weird one, he wasn't charged with rape but with sexual abuse. He is not going to serve any prison time, but even 6 months suspended with 2 years probation could be seen as harsh for what is a case of mistaken identity.

Thats a bizarre judgement, this is however a very unusual case. The judge didn't throw the book at him, nor has he been placed on any kind of register. I'm not entirely sure how you are meant to make sure that a woman who is having sex with you knows that it's you.

Again I repeat, this was not rape, nor was it judged to be rape, nor was the man charged with rape. If you pretend to be someone else to have sex with someone it is not rape. However If the man delberately deceived this women in order to trick her into sex it's not the same as consensual sex, while I don't consider it criminal personally I do find it pretty rotten and I can understand why this judge in this case found it to be criminal. However it is not entirely clear if the man maliciously tricked the woman, or if the womam merely mistook him for a known lover.

I strongly doubt a case like this would receive the same judgement in the U.S.A.

I think he probably got off light. If I understand correctly, the woman set up a situation where she would have sex while asleep with only a particular person (or set of persons).. The convicted man had sex with her but wasn't someone she had consented to have unconscious sex with.

This article is really too short (and Swedish) for me to say. For instance, I can't tell if she told him to fuck her when she fell asleep but actually meant to tell someone else then he didn't do anything wrong. Hell, the title could just be mistranslated or wrong and she wasn't asleep. Not unlikely since the article says she mistook him, which she would have to be conscious to do. If she wasn't asleep then this ruling denies female agency by putting the onus on the man, which is bullshit.
