A false sex-assault accuser has been sentenced: 12 years probation and "court costs and fees totaling $290 in $100 monthly installments beginning 30 days after she was sentenced." Basically, probation + the cost of a Nintendo Switch, on an installment plan.

The accused in Ms. Garrett’s case was given the choice to accept responsibility or face a formal hearing. In accepting responsibility, the accused was merely given a deferred suspension. In sum, a white male student, accused of the same violations as Plaintiff, based on more egregious facts received a deferred suspension and no expulsion. In contrast, Plaintiff, an African American student athlete, was permanently expelled and arrested for the same alleged conduct.

Sadly this doesn't surprise me at all. They also argue the threat of losing funds motivates the decision of the school on these cases and they are right. If the school does nothing they get in trouble. If they condemn him independent of the facts, there isn't a whole lot of support for him. It is a balance of risk and the risk is substantially weighted to the school being bias against a respondant.

The bias of our judicial systems should be in favor of the people accused. Always. The nature of Title IX creates a situation that motivates the schools to do the opposite. It's hard to fix a system that is fundamentally broken in design. I don't think it is possible to fix this without a third party judicial system and in that case we have it. Real courts independent of the school already exist!

I would contend that false accusations include ones where the accuser does not lie, but various other situations occur, such as when the accuser misapplies the laws and the person is almost immediately (relatively speaking...the investigation still takes weeks or months) deemed innocent, without any facts being in dispute. In some studies I've seen of police investigations, these types of accusations are marked with "Closed as informational report", and constitute around 1 in 5 cases. Those fit the "false accusation of rape" definition.

He's not suing the accuser. He's suing the university and alleging an unfair process. Schools have to provide a fair and nondiscriminatory process when they investigate accused students regardless of whether there is proof the accuser lied in a parallel criminal case.

He had a contract with the college. To break that contract, the school needs just cause. He’s essentially arguing the college is denying him what is due him without adequate proof they have cause to break that contract. Also by claiming he committed an act he may not have, the college is negatively impacting his future opportunities.

If colleges are going to conclude students committed a sexual assault and sanction students, they should have proof these claims are true including offering the accused proper due process which colleges often do not.

More and more colleges are being successfully sued for denying due process to accused students.

You seem to have the burden of proof reversed. The accused doesn’t have to prove the accusations against him are false. It’s the burden of the “prosecution” (college) to prove the accused is guilty. If they don’t offer due process they fail to meet this burden.
