Brother is a lawyer. He said in todays legal environment, you really need a prenup and a postnip, because they can claim that they signed the prenup “under duress.” Don’t get married.

Personally, I think a prenup is necessary in almost every situation.

Only time I think you don’t need a prenup is if one of the parents plans on staying home full time with the kids, because in that case a prenup likely wouldn’t be fair since the person living at home may be essentially thrown out in the streets lol

In theory, they are great. As a practical matter, not so much. Whether one is enforced or not is largely in the discretion of the family court judge. Legal proceedings are expensive and time consuming, appellate relief isn't available until there is a final judgment, and judges thus know that they can do whatever they want with limited to no oversight by a higher court. That's why nearly everyone settles. Prenups are more of a negotiating tool than anything else. Even if a court ultimately enforces one, you'll spend a fortune getting to that point.
