I've been married for several years in Oklahoma and came into the marriage with a rental property. We keep all of our finances separate and I have a prenup in which she gives up all marital claim to the rental. I recently purchased a second rental using the equity from the first. I was explicite during the entire process that I did not want my wife involved. I was assured that she would not be, but two days before closing on the loan I was told she had to sign away rights to the house, (even though she had none to begin with) which i found odd but went along with it anyway. A few weeks later I received a "correction quick claim deed" in the mail with her name on the property. in other words, she now owns half the rental. I was furious and contacted the title company and they informed me that it was mandated by law and also that they were instructed to do so by the mortgage company. So I called my loan officer and at first he said it was a mistake and that the correction was just to take her off the deed. The next time I talked to him he changed his story saying that it was mandated by law and that he had told me this all along! I never agreed to this and I feel like I just got robbed. I immediately called my lawyer and he told me there is no such law requireing her to be on the deed and at most they just needed her to sign a paper saying she was aware that I was taking out a loan. The only solution is for her to file another quit claim deed in which her name is taken off which luckily she is going to do, but I still feel like what the title and mortgage company did was illegal. What should I do at this point? Do you think I could get them to pay my attorney fees, or report them... im not sure what to do at this point. the problem is resolved but I had to take care of it and they never so much as apologized.
