After reading the details it seems clear the man was(as found) innocent. The woman admitted she had consensual sex and even if she really did think she was having sex with her regular boyfriend that was HER error not the guy she was having sex with . For the record I think the accused is a real scumbag for shagging his mates girlfriend but that is another matter.

This one's pretty clearly a mistake on the girl's part. The dude's a scumbag for doing it, but he was drunk too, so, bad decisions all around. I'm glad the verdict came out correctly.

It probably went to trial because of another case where a guy deliberately tricked and switched places with another guy after he turned out the lights. They're now changing Idaho law so that that can classified as rape--which is not something I'm against, honestly, if there is an obvious collusion like that (proving it would be the hard part). Because there is no confusion on the "secret" man's part in that circumstance--he very much knows she did not consent to sleep with him.

The one in this case, though, is a bad friend, but not a rapist.

Cdr Reed said Mr Dinnell began to kiss her and, in a "drunken and unconscious" state, she believed it was the friend.

He said "things progressed" and ended up with Mr Dinnell having intercourse with the victim.

Cdr Reed said the alleged victim then realised it was not the friend.

He said: "She pushed him off and said 'no'."
