His legal rights will be very different depending on your location. It is really really important that he does take legal action to stop this though, once a pattern is established it is harder to change the status quo. Having been through it, my advice would be to call whatever authority you went through for child support and ask them who you should talk to or how you can get legal assistance. You might have better luck getting answers if you make the calls instead of your fiance. It is a hard fight, I hope you can get some answers and support.

You need to establish visitation, phone calls, summer vacation, etc; not only to be a more stable part of the child's life, but also because this will lower his child support But he needs to establish visitation NOW; you don't need a lawyer, I didn't. You do need to go to court, and maybe more than once.

There really isnt a way that all of this will just work out so everyone is happy and not on eachothers back, the legal system isn't really designed to help separated parents get along.

I'm going through this right now too. You can go to Family Court to enforce visitation.

This probably won't be a popular opinion, but you should consider that paying for his daughter's child support is one thing, visitation rights are another. Just because he pays support does not mean he has the 'right' to see his child on demand. The child's rights always come first. Of course, I don't know this particular situation, but harrassment can be defined as five phone calls in one day.

Does your fiance want to be involved (beyond walking wallet) in his child's life? Have him post at these forums. He has to post, though, not you...lest his uninvolvement signal disinterest.

Those guys have experience negotiating the legal system to help men have time with their children. They have a no-nonsense attitude, focused on evidence-gathering and being the better parent.
