So the universities think they have to maintain a statistical balance between the number of athletes of each gender, and the number of students of each gender. Do they have to maintain a statistical balance between the number of people in society of each gender, and the number of students and graduates of each gender?

Nice to see law firms advocating for men under Title IX. Usually all I hear is "we dont take these kinds of cases." This is a big deal because OCR is so political. It is prudent to get specific rulings in court that can be referenced to force action by OCR.

This is good news. I am interested in what angle they will take on Title IX. The do correctly call out that OCR stating a defense is not the same as OCR stating a requirement of compliance. It looks like the school attempting to produce parity as a possible defense by cutting this team was incredibly misinformed. Very typical of school Title IX offices.

From reading, it looks like they are going after the choice to cut a team being based on the gender of the team, which is not allowed under title IX. They cite equal treatment so they are going for a disparate treatment argument.
