Yeah... the guy originally stated that his partner had beaten him and caused his injuries. Upon further inquiry, he recanted his testimony that the woman had beaten him. He stated for the record that he'd fallen and his his own head.

The woman got 16 months incarceration for what amounts to basically assault, that she actually admitted to in court (and probably only got 16 months because she'd just been released from a 6 month stint for the same thing).

Looking at manslaughter/murder, the judge's ruling is unsurprising given that the man himself testified that he'd fallen and hit his head.

This is a pussy pass situation for sure because if the roles had been reversed, the DA (or whatever the UK equivalent) would have gone for a full Murder 1 (or UK equivalent) charge against a man who admitted to striking the woman, even though the woman swore that she'd fallen and wasn't injured from the man's attack. Chances are that the man would be sitting in supermax for life too.

For whatever it's worth, this pattern is all too familiar for the victims of domestic violence/abuse. The reason cops are so familiar with it is that they also see the same sort of recanting from women victims of abuse. This case proves two things:

1) Domestic abuse follows similar if not identical patterns regardless of the sex of the perpetrator and victim.

2) Sentencing and prosecution of domestic abuse under the law is not even handed or even remotely interested in providing blind justice.

I remember this incident.

Aren’t CPS meant to prosecute regardless of what the victim wants in domestic abuse cases? Or did they not because he wasn’t willing to provide a statement to the police?

He was dumb enough to stay for round two, what did he expect? Men, like it or not, this is what the system is. Quit wasting your lives funding it!
