2nd degree murder is murder with intention but not premeditation.

1st degree murder is murder with both intention and premeditation.

While it was a bat-shit crazy thing to do, the sentencing seems correct to me.

Maybe I'm cynical but it seems here like she's establishing an alibi in case she did kill him so she could claim he was abusive (which she tried in the affidavit).

If men could reasonably expect to get away with murder by simply claiming in advance and during the trial that their victim was abusive I suspect there'd be a lot more "abused" men out there.

If she doesn't face the same penalty a man would in her position the system proves itself useless as usual. Anything lesser than first degree murder conviction is not acceptable.
