He was convicted for repeatedly grabbing her breast and pulling her hair after he'd been asked not to. So it seems a pretty fair case for sexual assault. Consenting to sex doesn't mean consent to do whatever you want.

But even by their outraged version, there was a lot of non-consensual activity going on in this consensual encounter.

I agree and disagree.

Rather than consent, the most important fact should be harm. And he plainly did harm her (slightly), so that's where I start. If there is no harm, I don't think ANY case should go to court.

THEN I move to the consent question, as a defence, And she plainly did not consent to that either. And there's no claim that this was the result of an accident. He did it on purpose.

I agree with the sentence, but not the post-sentence punishment (which ought to be unconstitutional) Even if the registry was useful, and legal, this person shouldn't be on it.

And NO accuser should have the right to remain anonymous. Courts are a function of the public's government, and identity is critical to monitoring how they are being used or abused.

Certainly the men in the area need to know that this woman in particular should not have her breasts grabbed during otherwise typical sex.

While there's an element of "she said/he said" in this case, it's pretty easy to grasp that consenting to sex isn't an open ended consent to anything the other person feels like doing to you.
