I didn’t realize this was in England. Utah code section 76-5-402 defines rape as

a) An actor commits rape if the actor has sexual inter course with another individual without the individuals consent. Any sexual penetration, however slight is sufficient to constitute the relevant element of a violation of subsection 2a

Object rape (including non-consenting oral sex 76-5-402.2) and sex with minors ( 76-5-402.1 any genitalia touching is defined as rape under this section) each have their own code specific sessions That are not gender specific.

Any non consensual sex act can be defined as rape under current Utah law but it might fall under different statutes. The fact that a guard was involved with a incarcerated victim would imply coercion independent of sex.

The revised UCR definition of rape is: Penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim. Attempts or assaults to commit rape are also included; however, statutory rape and incest are excluded.

By definition above from the Dept of Justice, being made to penetrate is not rape. Rape is defined as Penetration.

This definition was invented by radical feminist Mary Koss and placed into law by the Justice Dept.

Men will not get justice until being made to penetrate is included in the definition of rape.

redefinition of rape

The US justice department and FBI specifically changed the definition of rape in to include male rape. When that federal government changed their definition to include male rape they did it to catch up with the changes most US states had already made.

The new FBI rape definition states that rape is:
"Penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim."

So a woman who makes a man penetrate her against his will is not a rapist. Only if the man is penetrated is it rape.

You are probably trying to mislead this board.

If you don't believe the FBI website, the department of Justice website or the Utah state annotated code I don't know how else to convince you. The term without the consent to the victim doesn't say whether the victim is the person doing the penetration or the person being penetrated. Hell this would even include one dude raping another dude. The object rape statute would also extend that to someone using pretty much any kind of an implement on someone else. From a toilet bowl brush to a finger or a dildo.

I have not made any comment about whether or not you can get a local Police department to investigate it or a district attorney to prosecute the case. I think there is still a lot of discrimination that does occur where male rape victims are not taken seriously by the police or the prosecutor's office. But male rape is a prosecutable offense.

we published from the contemporary journal of criminal Justice

" A unique form of sexual victimization that often goes undiscussed and, therefore, underassessed is that of being forced to penetrate another person (i.e., forced penetration). Due to forced penetration being a relatively novel addition to the definition of rape, there is a lack of assessment tools that identify forced penetration cases."

Again this idea exists in the legal system although it's not well documented, understood or enforced.

Whether or not they were held down or even tacitly consented doesn't matter. The fact that they're in an unequal relationship with the guards implies they don't have the ability to consent without duress.

Just like a woman kidnapped by the Taliban and forcibly married to her rapist she still doesn't have the ability to consent, but I'm sure a sexist like yourself isn't smart enough to understand that either.
