Women have tons of services for DV, they have no need to flee the country. And if all you need to do to get sole custody is being a woman who claims to be a DV victim, then we have an easily exploitable loophole. And a great many women divorcing their husbands now claim DV or sexual assault. Given that, I have a hard time accepting claims of DV in a troubled marriage as a default.

Dude there are a lot of instance where fleeing the country is the wisest... if you say you are a victim of domestic violence they will help you, but nobody is going to hire a body guard for you... if there is danger for your life, you get the fuck out, and you do it with the kids, the justice system can be fast but its not that fast

fleeing will buy you some time while you can get a restraint order

a child is considered “abducted” if he or she is removed by one parent without the other parent’s consent.

It applies to both parents equally, so that's sexist. Best to have a feminist-approved law in which mothers are free to get sole custody and beat their children, who lack the right to benefit from the child support that the mom is owed.

For, like, uh, "equality" and stuff.

Everything about this is pretty dangerous...

For instance, the article doesn't mention what should be done in cases where this is only alleged. Is it trying to say a simple accusation should mean a mother can take the kids and vanish to another country?

It's worth considering that men are more often convicted of the same crime a woman was charged with, but the charges against her are dropped or lessened, and men are assumed at fault in cases of mutual domestic violence. This can just be a further way men are discriminated against should the law on abduction be changed.

Lastly, it brings into question exactly how much should you interfere with the relationship between a parent and child when the parent has committed a crime. As far as I know, we don't bar people from seeing their kids (besides prison) for crimes not committed against their child or other children.

You shouldn't be able to take a child away from the other parent without a court saying you can. The law is right on this matter, and sob stories like the one in the example shouldn't change that.

I've been abducted by my father and i've fleed with my mother so i kind of know both sides of the coin...

There has to be laws protecting the child from being abducted for quite obvious reasons, but there has to be a law that protects a family fleeing from one of their parents.

Regardless of the age of the infants, there are situations where you only have the posibility of geting the fuck out without even planing it...

If there is violence fleeing may get you some time while you manage to get a restrain order
