So the stbx (46f) and I (52m) have come to a settlement agreement in theory. Before it gets recorded, was hoping for some perspective. Married 27 years.
In MD, a community property/ no alimony calculator state, general rule of thumb at 1:3 duration for alimony.
We agreed she would keep the house (paid for) valued at $390k; I will keep my retirement ($325k); she keeps her CD ($45k); I keep mine ($25k) and we split all other accounts, custody and physical property 50/ 50.
Near as I can tell, my vested 401k balance (at current effective tax rate) leaves a delta between home value of approx $77k, which she has accepted in lieu of alimony.
My question is- is this fair and reasonable?
It also bothers me that it would be far more difficult to clawback money paid up front versus ceasing alimony payment in the event of a terminating act (remarriage etc.). Thoughts?
She would leave with the house and $75k, and me with my retirement, maximum income, and $50k.
I don’t want to get bogged down being a dick about clawback, if this is a deal I should jump at.
