All good advice, but be aware there are numerous ways for legally binding common law marriage to sneak up on you:

• Don’t file joint taxes returns. This is a biggie. It’s pretty hard to claim one didn’t intend to be married when one would be guilty of tax fraud by making that claim.

• Don’t list the cohabitant as a “spouse” for purpose of employee benefits. Another biggie. Defrauding an employer isn’t as bad as defrauding the government but it still is hard to explain away. I have had clients unwittingly married because they wanted to put their baby-mama on their employer’s health insurance.

• Don’t file any official paperwork in which the cohabitant is listed as a spouse. While tax returns and employee benefits are the two most common ways folks list a cohabitant as a spouse, filing any such documents listing the other as a spouse or claiming spousal benefits is an excellent way to end up common-law married.

• Don’t introduce the cohabitant as a one’s spouse, husband or wife. The third big no-no. It’s pretty hard to claim that one didn’t hold oneself out as married when one introduces that person as your spouse. Introduce the cohabitant as a cohabitant, boyfriend/girlfriend, roommate, paramour, concubine, my-old-lady/my-old-man, or friend-with-benefits if labels are needed. Just avoid terms that imply marriage.

• Don’t hold the cohabitant out as one’s spouse or hold oneself out as being married to the cohabitant. The final big no-no. Obviously it is hard to deny one intended to be married if one is holding oneself out as married. I have seen cases in which folks issued anniversary announcements in a local newspaper and in which one party later claimed he lacked an intention to marry. The family court did not find him convincing.

• Correct one’s cohabitant if he or she claims to be one’s spouse. Allowing other to believe one is married when one intends to merely cohabit can create a “reputation” of marriage. Failing to correct one’s cohabitant on the claim that one is married allows others to believe one is married. It further allows the cohabitant to believe one intends to be married.

• Correct others when they assume the cohabitant is one’s spouse. Again, allowing others to believe one is married when one intends to merely cohabit can create a “reputation” of marriage.

• Don’t title property or enter debts jointly using the same last name [this assumes the cohabitants don’t already have the same last name]. It is perfectly fine to have joint assets or debts with a cohabitant (although division of these assets and debts later on can cause problems). However, when one titles these assets or debts in the same last name it demonstrates an intention to act as spouses.

• Don’t take on the other’s last name (if one is female) or allow the other to take on one’s last name (if one is male). Checking into a hotel as Mr. & Mrs. Smith is strong evidence of an intent to be married if the man’s last name is Smith and strong evidence of a lack of intent to be married if the man’s last name is Brown.

My ex-boss married, had 2 kids back to back, then his wife informed(keyword) him that she wasn't going back to work because she wants to be a stay at home mother.

Had to pay full alimony, child support even at 50/50 custody(ex did not work), she even took half his pension, because of that he can't retire.

Do not get married ever! Your wife might be the best now, but if she decides she's a feminist, you are toast!

I would / will never get married. I see divorce simply as

if you are male, you pay her 50%+ plus alimony no matter who earns more.

In the minority of cases where the woman earns more... society gets outraged at the thought of a woman having to pay out or pay alimony. This outrage will probably lead to it being made illegal for women to have to pay out or pay alimony.

And I am also convinced that in those cases now....they don't.

Case in point was Adele's divorce. She had a judge sign off on making the divorce proceedings sealed, so no one knows what happened. My best guess, she leveraged her husbands right to see his kids vs payout and alimony and probably paid him zero, in fact I would guess he might even have to pay her alimony. And if he speaks about it... bye bye visitation rights. Of course there would be some outrage if this came out so it got sealed from public view.

Of course this will lead to bachelor tax paid by men and UBI for women only, in the future. The former has happened already in history, and the latter is currently being pushed in India and Canada and will filter West / South as per everything else. Think about it... charge men 25% bachelor tax, government skims 5% for itself, pay the other 20% monthly to all women over the age of 18 in the name of "equality". 55% of the population (women) will be delighted, and any men who complain will be shown as heartless or incels. Wins all round for the left.

I don't understand why anyone would think marriage was primarly a business/financial partnership.

If I were going to distill marriage down to one element it would be a stable environment to raise children. A close second would be a partnership for running a stable household for the sake of the health, stability and happiness of the people in the partnership.

Neither of those requires both parties to earn money, much less both earn equal or near equal.

And the idea of divorce as soon as one stops earning money or as much is just out of the question.

That said, I agree that cheating means nothing....unless a child is produced by cheating...and that aspect should come with penalities for the idiot that did that.

Next, just because there are no legal obligations does not make a promise between two people mean nothing. Of course it still means something. It means if its broken, one may seek a divorce.

I will also add that alimony is BS. This is not the 19th century anymore. Any normal adult can get a job and support themselves.

Also all states in the US have no fault divorce. Any spouse can divorce the other one whenever they feel like it. So, saying 'Till death do us part' has become meaningless.

let me play the devil's advocate here, I feel like no fault divorce is a good thing. I mean, we already know women accuse men of domestic abuse of themselves and children to get faster settlements and to blackmail men to get the worse deal when it comes to child custody, now, If you were to remove no fault divorce, there just would be more people claiming that men domestically abused them and the child, even when they didn't.

I’m an Indian citizen working in the US. Do these marriage laws apply to me if I get married in India but continue to stay in the US? Not that Indian laws are any good. They are pretty anti men as well.
