Well there are two problems with your position.

First, there hasn't been an exhaustive study on pregnant women and alcohol to see how much they can imbibe and still have a healthy fetus. Such a test would be morally wrong. Besides, in some cultures women drink alcohol during pregnancy. Who is to say what is a enough?

Secondly, a baby is somewhat is similar to a parasite while it grows in a woman's womb. It is part of her body. The state simply does not have control of her body, and that's not something you would want. Because if the state has control of her body, they can also have control of yours. Then the state has power to tell you what legal substances you can and not put in your body, or even your dependents. Just not good.

The mother is responsible for the life of a fetus once it's born. There is no guarantee the fetus will be born, nor a way to guarantee a healthy baby.

I think the spirit of your comment is good, however it's impractical to do what seems reasonable.

Actually there is a way to ensure a healthy baby. Don't drink or smoke. Its also why various medications have warning labels to tell a pregnant woman that she should not consume it while pregnant. You can have laws to attempt to prevent abuse of the fetus if the woman hasn't and is not planning on having an abortion. Its also late term we're talking about here. Just as drunk drivers are convicted if they are at fault for terminating a woman's unborn child. You can put fines on damaging your unborn child that you are planning to have. Its actually quite easy to do and not give control to the state of a persons body. Enforcement is the only real issue here. Also, if a fetus is like a parasite then it is not apart of the body. Which it isn't anyway. It has its own DNA, separate from the mothers.
