I was there battling a wife that wanted me to just, I suppose, give her the house. No, it seems unlikely to me that a judge roundabouts where I got divorced (CO) could compel you to own an asset that you do not want to own. I may well be wrong, but I believe this may be one of the few indignities that you’ll be spared in the coming joyfestival of divorce.

Oh hell no. If she (and you) wants the house and wants whats best for he kids then work on the marriage. I am not telling you to do that. Simply pointing out that’s the solution.

Otherwise you liquidate and move on.

File a motion to force the sale of the house. She can’t afford it, can’t refinance it into her name.

Unless you can subsidize the house expenses from now until the end of time. It will eventually go into foreclosure and the house will be lost anyway.

No, judge cannot force you to keep a house. One of three options are available if you cannot mutually agree to a deal. You buy out her percentage of the asset and keep it, she buy out your percentage of the asset and keeps it or it is sold to split the asset in the percentage the judge assigns in the divorce trial.
