Do you have all Documentation of her addition. Police reports, hospital reports, ambulance bills. You want open shut case to have primary custody. Don’t assume. Have the evidence stacked high!

Filing a protective order / temporary restraining order should be your first move if you're worried for the safety of your STBX and the kids. This will trigger an immediate CPS case. It doesn't have to be an emergent situation. Keep the police and hospital paperwork handy in case the court wants them.

But temper your expectations: drug use alone won't have an effect on custody or the divorce unless she presents an* imminent danger* to the kids. Being an addict isn't a crime. Using drugs doesn't rise to a family offense - if it did, we'd have the gestapo rounding up anyone with kids who ever drank or smoked weed.

This will be a wake-up call for her though, and it is your responsibility for getting her straight for the kids' benefit. The request for drug testing is probably a 50/50 possibility, and remember if they test one of you, they have to test both of you.

Keep documentation! Mine was/is an alcoholic and I am pretty sure does drugs. We had a full on court battle, witnesses, exhibits the works except a jury. At the "trial" I got custody, temporarily but had to see the court counselor for the final decision. The counselor was definitely not on my side, or even neutral until two things came out, 1) We were ordered to take a drug test at a specific testing center (she was a nurse so we made sure to pick a center not associated with her hospital, she failed to show which counts as a positive test 2) less than a week after the trial, she hit a tree in her front yard at 3:00 in the morning, with our son in the truck with her. The police report stated she admitted to drinking and driving, but did no breathalyzer. I told the counselor all this but she was still cold, then I showed her the police report and the no show for the drug test, she (counselor) did a 180. She actually started crying (over other things I told her son's mother did that she didn't believe me). When I provided proof of the accusations, the counselor (i assume) realized her judgement was initially wrong and all men are not evil and actually intervened with the court to allow me to move closer to work and expedite the divorce so I only had to wait the mandatory 60 period.

All of the above to say, even though I initially won custody, it was very iffy that I would keep custody until I provided evidence that my story wad real and not exaggerated.

You seem strong, and like you have a plan to get, you where you want to be. I just want to add one of those prayers. That allows you to control the things you can. Leave to the Lord the things you can't, and the wisdom to know the difference.
