Hostile divorce, includes ex filing (easily proven) false order of protection. GAL even called it out during a hearing. "I find her accusations wanting and haven't seen proof of anything", "Dad doesn't have any mental health issues that would concern me regarding his ability to care for his children".

Since October 2021, after being unlawfully evicted from my home, my ex has played wack a mole with my personal property. Put some stuff in a storage unit after saying 'everything' was in storage after a hearing to dodge being forced to let me into the home. Then court found out she lied so I got an order into the home. She hid property so I couldn't get it when I was in the home. Constant back and forth trying to compel her to return stuff. Ignores it. She's basically a thief at this point. Even got verbal orders from the judge to 'just give dad his stuff back', from a judge that specifically said she doesn't appreciate having to write simple orders in plain english on paper and putting a stamp on it, and prefers people just take verbal orders. Despite judge saying this, guess what? No action.

Some of the stuff is my step-dad's, not mine, so my lawyer points out that stuff isn't beholden to a divorce settlement to be dealt with. Step-dad can take his own action. I give ex multiple chances to just 'do the right thing and give my step dad his stuff back'. Ignored. Threaten to sue her. Ignored. Step-dad texted her directly at one point, and she replied 'stop texting me'.

Step-dad filed a suit in small claims court this past week. She got served by the county sheriff at the marital home. She immediately contacts my step-dad and says she's going to start putting stuff 'in the driveway' for my step-dad to come get it.

Here's where she is trapped.

  1. It proves all along she's been perfectly capable of reaching out to my step-dad to return his stuff.
  2. It took her being sued to get her to do the right thing.
  3. There's no reason she couldn't have just done this 2.5 years ago.
  4. The length of time this has gone on proves its part of her character, not just her having a bad month.
  5. I just spent $13,000 on a psychiatric evaluation which is scheduled to be completed by.... checks notes... 2 weeks after our small claims court trial date. The outcome in this trial will come just in time to tie a bow on the evaluation.
  6. I told the evaluator the entire situation about the personal property and that the reason my ex can't be trusted with a custody plan is that she's completely unable to do the right thing unless she's forced to. And that I expected she would only return property if she got sued, so she proved me right.
  7. Part of why the evaluation is so expensive is because I have extensive evidence that she's likely a psychopath (threatened to kill my cat several times, among other things), and again... checks notes... stealing/withholding property that isn't yours is a feature of anti-social personality disorder, which is the official DSM-5 label for the spectrum of narcissism, sociopathy, and psychopathy.
