First. She is only trying to get you to look bad by making her pay out of pocket for out-of-network. She's failing miserably and showing that she's being petty. The judge will love this, don't worry about it, it is to your favor.

She has primary custody and so generally can make decisons on day-to-day care and possibly emergency care.

If she decides on out-of-network for non-emergencies, that is literally her choice and it looks like you have that covered. For out-of-network costs for emergency care, you can fight/request a review of your case with your insurance company because there are laws protecting you from that bullshit.

One key phrase is "final say". This does not mean "only say". As co-parents, each of you are expected to put in a good-faith effort to come to an agreement on how to handle a situation. If and only if that fails, can the parent with "final say" disagree and do what they feel is in the best interest of the child. You both signed the decree that probably states as such. It's a legal document, court approved, and any violations could result in contempt of court.

You want your kid to go to Doc A, she wants Doc B. You have a discussion, an email, a text. If she has final say and you can't convince her to use Doc A, she is within the right you both agreed to, to make the final decision. Unless the situation is an emergency and time is critical, she cannot simply make the decision without your input. This is so frequently overlooked I thought it important to mention.

As for wanting to change herself to a custodial agent on your insurance, and the other things you mentioned, they don't make sense to me separate or when considered altogether, unless of course she's got an ulteriour motive. Why change, and why now?

Maybe she wants to try to get into your health claim information (she won't be able to, anyway), or maybe she thinks putting your kid on her insurance will allow her to have a "change in circumstance" and use THAT as an excuse to request a change in child support or spousal support. Maybe she wants to try to uno-reverse the out-of-network expense thing, so she can financially abuse you by putting you on the hook for those expenses, since she purposefully decides to go out-of-network already..

Just say no. Court is not going to want to change agreement that she agreed to.

Consult an attorney. My ex said all sorts of shit she wanted to change. I saw a lawyer and he said the court is not going to agree to any of it, and in fact she violated the out of pocket expenses. She then changed her tune 180 degrees.

You should bring up everything that she has been bull shit and not following agreement

Her plan is either to make you miserable or to remove any say you have in the matter. Which is basically her using your insurance for your kid.

Make sure you document this any way you can and then go for joint decision making in healthcare.

It’s probably a good look that you covered your kids so the judge will HOPEFULLY tell your ex to quit being a little shit, you never know though.

Document and give these instances to your lawyer.
