IS CIRCUMCISION A FRAUD? Peter W. Adler, Robert Van Howe, Travis Wisdom & Felix Daase

This Article suggests that non-therapeutic male circumcision or male genital cutting (MGC), the irreversible removal of the foreskin from the penises of healthy boys, is not only unlawful in the United States but also fraudulent. As a German court held in 2012 before its ruling was effectively overturned by a special statute under political pressure, cir- cumcision for religious or non-medical reasons is harmful, violates the child’s rights to bodily integrity and self-determination (which super- sedes competing parental rights), and constitutes criminal assault. MGC also violates the child’s rights under U.S. law, and it constitutes a bat- tery, a tort and a crime, and statutory child abuse. Building upon a 2016 case in the United Kingdom, we make the novel suggestion that when performed by a physician, MGC is a breach of trust or fiduciary duty, and hence constructive fraud, where courts impute fraud even if intent to defraud is absent. We reprise and build upon the argument that it is unlawful and Medicaid fraud for physicians and hospitals to bill Medi- caid for unnecessary genital surgery. Finally, we suggest that MGC con- stitutes intentional fraud by the American Academy of Pediatrics (AAP) and most physicians who perform circumcisions in the United States. They have long portrayed MGC as medicine when it is violence, and as a parental right when males have the right to keep their penile foreskin, and physicians are not allowed to take orders from parents to perform unnecessary genital surgery on children. Various aspects of potential lit- igation would be favorable to the plaintiffs. Hence, we conclude that MGC exposes physicians, hospitals, and the AAP to large and possibly uninsured liability

It’s interesting this is so easily accepted, yet there are huge restrictions on using placental STEM cells. Placentas are naturally discarded after birth and the woman consents to it being used medically. Foreskin in contrast is surgically removed without the donor consenting.

All I know is that all those cars in the driveways of doctors certainly look very expensive. But according to some apologists in this very thread – who argue in favour of taking away the right to bodily integrity for infants – the obvious reality we all see of filthy rich circumcision doctors is only because of "other procedures" they do, because they make "practically nothing" doing circumcisions. Strange how the hospitals maximize profit on every other surgery they do, except for this one. And strange how fathers who are against circumcision have spoken in this very sub describing their experience after their newborn boy was born, and they've relayed how they had to specifically refuse the procedure almost a dozen times in various documents and verbal questions from nurses and doctors.

Hmm...sounds like the hospital is really trying to upsell new parents on their services for infants, doesn't it? Seriously, how anyone can argue this isn't a huge cash cow is beyond incredulity.

As an aside... Donated bodies, organs and tissues are sold at a profit. That donor card a lot of people have is a classic grift and the card holders are the grifted.

Your dead body is worth about $50k rental when parted out. Also, the people who collect tissue, connective, bone, membranes, optic: cornea, eyes, etc. are just highschool educated guys with boning and skinning knives and a cooler.

What's returned to your family if they take the whole body is nothing or cremation remains from a mass cremation disposal (pretty much any organic medical waste tissue) not an individual cremation.

The information just gets more depressing the more you learn and go down the rabbit hole of body, organ, and tissue donation. They have more donors than they need for starters. Secondly, many morticians are now harvesting "non-consent required tissues" from "customers". Blood Plasma as an example. Sections of organs and tissues can be harvested and sold, microscope slide sets of human tissues and cells for example... A full set can sell for $1k and come from your uncle made by his mortician without consent required.

Long story short we got ghouls.

I think Adler, et al. are incorrect. First, the $1,750 amount refers to adult circumcisions; infant circs are closer to $300 and often bundled in maternity costs regardless if the boy is cut or not, or a girl. Second, hospitals don't sell foreskins. Selling human tissue is illegal. Hospitals (and tissue suppliers) can charge to cover processing costs.
