Cocaine_face, I can tell by your username that you are a pretty enlightened individual. So you surely know that the Free Speech Clause of the First Amendment is subject to several limitations, including state police powers to regulate expressive conduct for the protection of legitimate safety and health interests. That is, for example, why state anti-harassment laws have been consistently upheld against First Amendment challenges. That being said, I think this proposed "street harassment law" is total bullshit, and would either be struck down as vague and overly broad, or subject to a limiting construction that severely limits its reach.

When the terms of a speech restriction are vague and overly broad, the risk is not under-enforcement, it is the exact opposite: over-enforcement. It creates a pretext to detain, arrest, and incarcerate mostly low income males who are forced to take a plea or ACD.

Talk about a non-starter. Completely unconstitutional. No speech based on sex and orientation meant to intimidate? Reminds me of WBC and plenty of campus/street preachers. Not that I approve of either, but I'm not about to censor them "because feelings".

Unconstitutional is not a word to throw around. This proposed law could be attacked facially or as-applied. Courts hearing a facial First Amendment challenge to anti-harassment laws like this usually determine the law's terms and scope to be vague and overly broad, and the state redrafts the legislation to narrow its scope and issue enforcement plans that specifically articulate which conduct the law applies to.

Laws like these already exist in places like Dubai and Abu Dhabi. I'm still waiting to hear these laws being abused. Because women there have self-respect AND self-confidence and, in reality, don't need those laws, but they exist out of RESPECT FOR THE FEMALE GENDER, because the women there are WORTH BEING RESPECTED. Not in NY, and most of the northern US, unfortunately. This actually goes to show how ingrained the entitlement culture is in the US.

In France, they are going to or have passed a law making it illegal to hit on a woman in public.

I am not sure on this one. But some countries have made it illegal for a man to make the first move. Costa Rica might be one of those countries. Again. I am not sure about this.

But don't be surprised if the Democratic Party wants to pass something. Democrats like to kiss the ass of single women.
