In a community property state you wouldn’t be entitled to inheritance even during marriage, as long as it isn’t commingled with the community estate.

About a year after my mom died my wife and I ended up split up split apart. And my dad started doing the Grieving widower thing and getting rid of all of my mom's stuff and sending it all to me none of which my ex-wife wanted or cared about period until suddenly she found out that I had all of my moms family vintage furs from the 1920s and now suddenly those are supposed to be for her and she and my mom and talked about it and her and my mom had agreed that those would be hers if my mom ever passed away blah blah blah. IANAL, but I handled my wife's estate.

Tell your friend to relax. As an ex, she has "no standing." She can threaten all she wants, but she's entitled to nothing. Hopefully, his dad had a trust set up, which, unlike a will, is private and in most cases the estate won't go through probate. If the estate is probated and she's not in the will, she could make a claim as a creditor, but it would be highly unlikely to pass muster in probate court.

But in 9 years, when I no longer have to talk to her again, I'll tell her: I made 65k off the house and that you signed over to me at the divorce. I got 200k in inheritance a little later. Enjoy your (still, after 10 years post graduation!) 120k student loans!

I've always wondered about inheritance in a marriage. Say a husband has a $500K house when he marries, they get divorced when the house is valued at $700K, and wifey is entitled to $100K. I get that.

But supposing this same wife has a mother who has a $500K house when the daughter marries, and is valued at the same $700K when daughter gets divorced. So the mother's house has had a $200K increase during the daughter's marriage. The mother then dies and leaves the house to the daughter. Why isn't the husband entitled to $100K that the house increased during their marriage?
