Child support(Texas)

Texas only looks at the numbers. They will base your child support on your total income. Almost zero percent chance of getting around it. I work in a refinery and my base pay is half of what I make with overtime hours, which I've worked a lot lately due to turnarounds. I told the judge that my overtime isn't guaranteed or steady. Didn't matter. He saw the numbers and made me pay max guideline child support. I pay $2300 a month for 2 kids. If I don't get any overtime, that's about half my check. It's not set up in your favor at all, especially in Texas. Just get used to the idea of being broke or try to work it out.

I can’t speak for TX, but in WA it’s not something you agree to. There is a table and calculation based on number of kids, total income and your percentage of total income. If TX has something similar I’d talk to a lawyer before agreeing to pay a different number. Last thing you want is to have your ex coming for back pay because the agreement was contrary to State law.

$640 must be a lot different from what you're paying now based on your reaction to it. My ex was calculated to pay me $725 but we deducted $125 so she only pays $600/mo now. I don't feel upset about it because she has been paying for things like a couple of extra curriculars, clothes, etc in addition to the child support.

$600 may seem like a lot but put it in perspective too. That is a car payment.

Anyway, my exW would try and boo hoo about it and say the same thing about how we don't spend that much on our child. I have custody, and would remind her about room, board, transportation, utilities, internet/phone, video games. Those things cost $$$.

Unless you both have 50/50, I don't see how you could wiggle out of it if it ever went to court. Can you imagine having to back pay it all? If you could get her to sign off on an agreed amount, then it could be filed and you wouldn't have to worry as much. But that would be tricky too. Is there a way you both could agree on a binding amount that is lower than $640 like me and my ex did?

Also, if your child is on your insurance that would lower your support calculation. There may be other items like that to lower the calculation.

If you two agree to a number, get it signed, notarized, and move forward. There will be no need to go to court with that. Note on your check “child support” as part of CYA.
