Of course you should try and sort it out. If you already have a lawyer, sure, mention it. One more thing on the pile. I wouldn't pull in a lawyer over dog visits, but I guess it's how much you love the dog and how much money you have to burn. Remember that the dog is property, if you're not fighting over other stuff, you could "trade it" for the dog. It's good she doesn't want to make it a point of contention, and you don't want to make other property a point of contention. That sounds like a reasonable trade. ra ra middle-ground, all that jazz.

Eh, honestly we spend so much money and time trying to get the ex in some sort of quandary. Your lawyer knows about the temp hearing, and it's just another knock against her. But courts don't give a crap about what parents do to one another. Just the kids. If you can document abuse great, but unless it's against the kids or it's so egregious that it can't be ignored nothing will happen but 50/50.

Half the time you'll lob back and forth, and a week before a hearing they're molly misses and nothing changes. You can go broke trying to bring every little thing in front of a judge. They'll fight for custody up to the point that a judge doesn't believe her tells her to work it out and then sign a stip granting custody.

now if it's legit abuse go all the way. Trial, TPO's and all that. But courts are filled with people claiming abuse. Vast majority of the time, it's one parent trying to screw over the other.
