Father with joint custody here. Former drug addict and lost custody when I was doing meth got my kid right back after I got sober over the protestations of the mother.
At least in California, even a non custodial parent has significant rights, and the courts determine for the most part that kids develop better if both parents are in their life. It’s pretty hard these days to lose all custody entirely and custody can be an ever changing thing. My custody arrangement has changed 3 times in the past 5 years. Just because the court dictates something is in a kid’s best interest now, that had little bearing on what that means in 1 year. I believe for the most part with kids that are under 1 they like the majority of the time to be with the mother, but after that move towards equality.
I’m in the sober community and most of my buds have gotten their kids back, even the ones with multiple violent felonies and/or things like bipolar disorder
