So here we have the emergence of The Female Serial Rapist/Sex Offender out of the gloom.

[–]rg57 2 points3 points4 points 9 years ago (0 children) | Copy Link

It's almost as if these people have a solid sexual relationship, and society has no business meddling with it.

I didn't bother reading the article. Can someone tell me whether or not we have a victim here?

Can someone tell me whether or not we have a victim here?

Just because a minor child wants something, doesn't make it any less harmful to give it to them.

Minor child really wants heroine... I know it's illegal, but he wanted, so I shouldn't be held accountable for giving it to him.

Minor child really wants tattoo... I give him one, and now he's got Hep C, but I shouldn't be held accountable because he wanted it.

Minor child really wants to have sex... now she's pregnant, but I shouldn't be held accountable because she really wanted it.

Minor child really wants to have sex... now I'm pregnant, but I shouldn't be held accountable. It doesn't really matter if he wanted, he should be held accountable. He'll have to pay back child support when he turns 18, until our child is 18, but he'll likely never be able to see his child, and there's nothing he can do about it.

A 15/16/17 year old is a "minor child" by law only. A 12/13/14 year old may or may not be a "minor child" depending upon the individual. Under 12, you probably are a minor child, but there are also likely exceptions to that.

[–]HeForeverBleeds 2 points3 points4 points 9 years ago (5 children) | Copy Link

A 15/16/17 year old is a "minor child" by law only.

There are plenty of 16/17-year-olds who aren't developed enough to give informed consent, and few under that who are. It isn't by law only, because the law is based on when people generally mature

[–]rg57 1 point2 points3 points 9 years ago (1 child) | Copy Link

the law is based on when people generally mature

It really isn't. That's why it's so different around the world.

[–]HeForeverBleeds 0 points1 point2 points 9 years ago (0 children) | Copy Link

It ranges from 0 to 21 with the average being 16 and it being 16-18 in the majority of countries internationally. Why do you assume that the minority that have it at none or 12/13 have the right idea when the general consensus has it at 16/17? Not everyone will agree where to draw the line, but that doesn't change that it's based on when people generally mature

[–]SodaPalooza -1 points0 points1 point 9 years ago (2 children) | Copy Link

And there are some 36/37 year olds who aren't bright enough to give informed consent.

[–]HeForeverBleeds 1 point2 points3 points 9 years ago (1 child) | Copy Link

Hence why the law is based on when people generally mature, not on exceptional 36-year-olds who can't or exceptional 14-year-olds who can

[–]SodaPalooza -1 points0 points1 point 9 years ago (0 children) | Copy Link

Right. Which goes right back to my original question "was there a victim here". You are now correctly pointing out that just because one party was under age, and just because sex with that person was against the law because of that age, it doesn't mean that the person was a victim of anything.

[–]bufedad 0 points1 point2 points 9 years ago (6 children) | Copy Link

Yeah... of course they are. That's why we let them sign contracts and enter into legal agreements. Because they are competent enough to understand what they are agreeing to. Right?

[–]SodaPalooza 1 point2 points3 points 9 years ago (4 children) | Copy Link

You're making no progress here. I disagree with basing those laws upon chronological age as well.

If a competent 16 year old signs a contract to purchase a $7,000 used Honda Civic that he wants, drives the car happily for 8 years, who is the victim?

[–]bufedad 0 points1 point2 points 9 years ago (3 children) | Copy Link

If a competent 16 year old signs a contract to purchase a $7,000 used Honda Civic that he wants, drives the car happily for 8 years, who is the victim?

And if a salesman sets him up with a 58% interest loan... who's the victim?

The 16 year old, of course. Which is why we don't let them sign contracts at that age.

[–]SodaPalooza 1 point2 points3 points 9 years ago (1 child) | Copy Link

Why is the 16 year old with a 58% interest loan a victim but the 19 year old with the same loan isn't?

(admittedly bad example since usury laws protect people of all ages, but you get the point).

[–]bufedad 0 points1 point2 points 9 years ago (0 children) | Copy Link

Why is the 16 year old with a 58% interest loan a victim but the 19 year old with the same loan isn't?

Is the 19 year old with the same loan a victim? Possibly. However, by that time, we agree that he should know better than to sign something like that.

We also agree (as a majority) that 16 years olds don't know better than to sign something like that.

[–]mwobuddy -1 points0 points1 point 9 years ago (0 children) | Copy Link

I completely agree. Sex is contract based, and thus when we have two 15 year olds banging it out for a few weeks we should definitely send the male to juvenile prison and put him on the sex offender registry, since he's violating age of consent laws and harming another minor/child.

[–]mwobuddy -1 points0 points1 point 9 years ago* (0 children) | Copy Link

Yeah... of course they are. That's why we let them sign contracts and enter into legal agreements. Because they are competent enough to understand what they are agreeing to. Right?

Is sex a contract?

How about a handshake?

[–]andejoh 0 points1 point2 points 9 years ago (2 children) | Copy Link

18/19/20/21 year olds who are probably minor children by your definition and not just those who are intellectually challenged so does someone have to get a doctor's note certifying that they are mature enough to have sex or it's illegal?

[–]SodaPalooza 1 point2 points3 points 9 years ago (1 child) | Copy Link

Age limits make enforcement easy. That's why we have them.

Ideally, everything would be a case-by-case basis. And if a 24 year old teacher has sex with a 17 year old student, society would be able to determine whether there was a victim or not rather than just defaulting to their being a victim.

[–]andejoh 0 points1 point2 points 9 years ago (0 children) | Copy Link

I'm unsure that's true. A person may not realize they've been damaged or may deny it because of immaturity. What if the 17 year old realizes that he was actually raped when he's 26? Should they be able to charge her 10 years in the future?

There are certain things the law states a minor can't consent to like drinking. They can't enter into a legal contract. Now some minors have been able to go to court to be declared adults. If sex is that serious, that seems your answer. Go to court and be legally declared an adult.

[–]rg57 -1 points0 points1 point 9 years ago (1 child) | Copy Link

This is absurdity. Sex is not heroin or hepatitis. And sex is a highly positive component of most people's lives.

To the extent that a male's right to refuse fatherhood of a genetic child isn't respected, of course we can fix that law at the same time as we fix the laws on sex.

[–]bufedad 0 points1 point2 points 9 years ago (0 children) | Copy Link

This is absurdity. Sex is not heroin or hepatitis.

No, sex isn't free money either. Would you care to explain why that invalidates this analogy?

And sex is a highly positive component of most people's lives.

Yep, but we aren't talking about most people who can make an informed consensual decision. We are talking about minors.

[–]rg57 1 point2 points3 points 9 years ago* (1 child) | Copy Link

The article is, as always, short on detail. But it's safe to assume that, no, there is no victim (unless you count the law itself as the offence -- then they are both repeat vitims). When there is actual harm of any sort, or even if there's not evidence of harm but also no evidence there ISN'T harm, they like to play that up, because it justifies what they've done to these people.

[–]mwobuddy -1 points0 points1 point 9 years ago (0 children) | Copy Link

I read it.

presume it is 15 year old male and female. Father comes home, finds female getting dressed and male naked in bed. Father is pissed cause male "ruined muh daughter". Que shotgun wedding jokes. Then male and female run out the door.

Female in this scenario is victim of male, who seduced her and she wants to run off with him, because she's not thinking right and has been groomed by him.

Make female older, and make male the father's child. Now female seduced male and he wants to run off with her because he's not thinking right and has been groomed by her.

Afaik, rape victims don't calmly get dressed with their rapists, nor do they run out of the house with them when the rapist is caught.
